Given the unprecedent, unexplainable and unexcuseable total absence of comrade Crabcake, MP, in fulfilling her duties as Member of Parliament since the date of his election, I hereby move for a revocation of her mandate in parliament gained through election on the party list of the Socialist Party. The move must be seconded by at least two members of the National Executive. Mrs. Crabcake, MP, shall then be considered as being expelled from the party list, and thus from parliament, and the next-ranking member on the party list without a personal mandate (in the present case, Nr. 1 - Mr. Cranberry), shall take the seat in her stead.

Err..Mr Leader with all due respect you were not the next ranking person on the party list at the last election. We are obliged to work with the list that was used at the election. This is the standard procedure that is used in countries using our electoral system.

Mr. Hifly, I have to respectfully disagree. As of our party constitution, the first spot on the party list is automatically reserved for the party leader. With the beginning of my mandate as party leader, I thus jumped forward to the first spot on the party list. The next position on the party list without a personal mandate being the number one spot, Crabcake's mandate will be transferred to that spot - currently occupied by me.

With the motion being seconded by two additional members of the National Executive, Crabcake's seat in parliament is hereby considered revoked, and Mr. Cranberry, the first person on the party list without representation in parliament, shall take the seat.

You're presence as No.1 on the party list will only be effective for the next election. For filling vacancies under the current electoral system we must use the party list as per the last election. This is standard and correct procedure. You cannot take the seat and it isn't the decision of this executive as to who takes the seat. It automatically falls upon me.

Secondly, this executive cannot remove Crabcake's mandate in parliament. Either Crabcake must resign, or if the bill proposed by PJ passes it falls upon the Speaker.

Precedent in such a case does not exist, so it is up to us to set this precedent. Party leadership decided this would be the way to go, alas, that's how it is. You are obviously the next one to get into parliament once another member resigns / is expelled.

Secondly, again, it is up to us to set precedent, which we did through this.
