There's no way to show efficacy if a practice is banned.  The thing about these types of laws, they don't just ban methods of therapy, some of which are abusive.  They ban aims of therapy - which comes awfully close to the government inserting itself in between the therapist-patient relationship. If the standard is the government is going to ban anything that hasn't been proven to be effective, then the practice of clinical psychology is going to be severely limited.

Why should something that is ineffective at best, and psychologically damaging at worst, be permitted in our society?  As Torie said, I think the burden of proof should be on the so-called "therapists" who practice this crap and the people who think our government should turn a blind eye to it.

The government has shown itself completely inept and oppressive when it comes to banning lead in children's toys after a law passed a few years ago.  Libraries have had to throw out children's books from before a certain date because they were printed before regulations on lead were put into effect, even though there's no reason those books would have lead in them.  Small toymakers and clothingmakers have gone under for the same reason - they can't afford the expensive tests that giant corporations can.  And all this was put into place because of toys found with lead that were made in China, not in the US.

I imagine anyone with hemochromatosis will be quite glad that it is legal.  For doctors who use bloodletting in ways that are contraindicated, we have these things called malpractice lawsuits.
