Reasonable, tho the devil is of course in the details.

Black supported the idea in the abstract but tended to be skeptical of efforts to invoke it tho.  His dissent in Dean Milk Co. v. City of Madison, Wisconsin gives a fair sample of his thoughts concerning it.
