This comes from Failblog, from the news.


An elderly woman is standing on a train platform.

A young man makes a foolish decision to run in front of a train in an attempt to catch another train.

The man is hit by the train and his body is thus flung and hurts the woman. She is injured and in pain.

The woman sues the man, sadly he died.

Here are the two sides as I see it.

1 - A "large chunk" of his body - after the limbs have been torn off - is what caused the injury. This man is now dead, and she is trying to sue his estate. Imagine learning your son is dead, and, someone is trying to sue 50%+1 of his body. How heartless could you be to do such a thing?

2 - Some idiot decides to run in front of a train and pays the price of his idiocy by being killed. As if that's not enough, this idiot's action have caused hurt to others. Of course because the idiot managed to rip his body apart, you are suddenly the bad guy. Of course you have a right to sue the person.

So...

Is she right or is she wrong to sue?

The way I had heard it is that she didn't sue the dead dude, she sued the station operators as, according to her/her lawyer, the train station should have known Chunks of Moron were going to be flying around and should have done something to stop it.

I've got a bit of work to do right now, but I'll try and remember to look this up when I get back.

ahh, I see she already tried to sue the station and the train and had it thrown out before she tried this route.

Something just seems very freaking wrong about suing a dead 18 year old kid.  There are plenty of people who make bad split second decisions and pay their lives for it.  Don't know the particulars of these things but if the poor parents have to pay a red cent it is absolutely terrible.

I'm on her side. What did she do wrong? This is not an act of God, its the act of a 18 year old kid. The kid should pay, but since he cant, the parents must.

Additionally, if you raised your son to be so stupid as to allbut commit suicide, then you SHOULD have to pay, morally and ethically, even if there was no other injured party.

You said yourself in the OP- the estate of the dead guy. If he was found legally responsible for her injuries, the damages would come from his estate.
