NJ city considers adult curfew after crime spate
8/18/2009, 4:38 p.m. ET
The Associated Press

(AP) — PATERSON, N.J. - Curfews might not be just for kids anymore in one city in northern New Jersey.

Officials in Paterson are considering one for people of all ages in a bid to curb violence after a spate of deadly shootings.

Several experts say they believe it would be the nation's first curfew of its type to include adults. The state ACLU says it would open Paterson to legal action.

The curfew would last for two months and would bar people from loitering outside from midnight to 7 a.m. Violators would face up to a $2,000 fine and 90 days in jail.

Officials are still working to make sure the plan can withstand legal challenges.

If the City Council passes it Sept. 1, a second vote and a public hearing are needed for it to take effect.

So would people who work night shifts be exempt? I mean, not everyone in Paterson is on welfare, right?

We had a curfew in Florida during the '04 hurricanes but we still had to go to work at 3am, therefore violating the curfew.

I'm actually quite sure that everyone in Paterson is on welfare.  This is the city that is so bad that the towns formerely known as East and West Paterson have changed there names to escape it.  The last time I was there thought it didn't seem so bad, but probably because I was right off the highway in the outskirts

It's not a ban on being out at night or driving to work.  You've just got to have a place to go or something to do.  It's a perfectly reasonable response to the recent events and local news coverage makes peoples' reactions seem tame if not ok with it.

That is actually probably true, but it has a lot to do with Paterson still having some nicer areas left while Camden has none.  Most of Paterson is just as bad as Camden

Unless it involves the first, fourteenth or fifteenth amendment it's irrelevant.

I wasn't aware that loitering at 3 in the morning was a right of the legal process.

If I want to sit on my porch at 3 am what business is it of anyone else?

Again, that's not what the curfew does.

Unless it involves the first, fourteenth or fifteenth amendment it's irrelevant.

It involves the fourteenth. "[N]or shall any State deprive any person of life, liberty, or property, without due process of law[...]"

I wasn't aware that loitering at 3 in the morning was a right of the legal process.

It deprives you of liberty without convicting you of any crime.
