Absolutely not.  A straight up curfew would be legal, but to ban older kids from trick-or-treating is discrimination.  And the ban on masks and disguises is asinine.  That would make costume parties the day before Halloween illegal.  And what about some Star Trek convention?  They can't wear masks?  And what's the definition of disguise?  Is a Santa outfit illegal?  The ordinance had good intentions, but it went WAY too far.

It is ridiculous to legislate such things.  Personally I keep 2 baskets of candy.  1 (the good stuff) for the real kids and/or their parents.  But I keep a 2nd one of stuff like "wheat thins" for kids I think are too old.

whether or not this is stupid and undesirable is a completely different issue.  how is this to be enforced?  cops roaming the streets on Halloween asking kids for ID?

But buying cigarettes and buying alcohol isn't a right.  You MIGHT be able to argue that ageism isn't a factor when it comes to trick-or-treating (it's public property, I think you have right to walk around, and then walk up to houses with lights on, since that's their invitation to you), but the ban on disguises is clearly a 1st Amendment violation.

I don't think we should have curfews, but when the do curfews, it's everybody who's a minor can't be out past ______ P.M.  With this it's saying, well, only 14-18 can't be out because this something young kids should do (as the Mayor himself said - not quite word for word).  They're not regulating crime or anything there.
