yes, even if they don't surrender or kill themselves.  It must be legal under all circumstances.  There's nothing in the Constitution to say it's illegal...

In theory I would say yes, but I fear that it could be difficult to determine whether or not the eaten person actually wanted to be eaten, and it could be a very difficult situation if the eaten person allegedly changed his mind at the last moment but was eaten anyway.  It's for this reason that I also now oppose the legalization of duels.

No and for similar reasons that selling an organ is illegal.  It can be taking advantage of someone who is mentally deficient or unstable.   Cannibalism is also very bad for you.  Brain diseases similar to mad cow are some side effects of eating human flesh.  These diseases are also hereditary and therefore damaging to puclic health and safety.

Armin Meiwes is facing retrial right now right here, and cannibalism is still not a crime under German law. Of course, killing someone (even with their consent) with the purpose of later eating them is.

No. Killing people with or without their consent should generally be illegal, and those who die of natural causes generally present problems of disease or medications tainting the meat.  Disposing of human road kill via cannibalism, while not in of itself a problem, would be such a small percentage of carcasses that it would not be worth the effort to carve out an exception to allow their consumption.

My problem with cannibalism are the same as Patrick's here.  It creates healh problems.  If it wasn't for that, and the deceased, pre-mortem, was competent to make the decision, I would have no problem.
