Absolutely, because of his position on federalism.

As AJ or CJ?

Not that it much matters, as my answer would probably have been yes either way.

No. I forget his actual quote but he once said something like if Congress has the power to stop destruction of the Washington Monument, then it has the power to stop destruction of the American flag.

No. I forget his actual quote but he once said something like if Congress has the power to stop destruction of the Washington Monument, then it has the power to stop destruction of the American flag.
"The creation of a federal right to post bulletin boards and graffiti on the Washington Monument might enlarge the market for free expression, but at a cost I would not pay. Similarly, in my considered judgment, sanctioning the public desecration of the flag will tarnish its value."

It was not, however, Rehnquist who said that; it was John Paul Stevens.

Yes, since when Rehnquist was nominated, I'd have long decided to vote for Richard Nixon in 1972 and, therefore, trusted his judgement. I know he came a cropper over another affair I won't mention but I think there was a lot of good in that man

Is it just me, or does Lewis Trondheim sound like opebo every time he expresses a political opinion?

Yes. He was probably the best justice on the court during his tenure as chief. I would rank him one of the greats.

Many times he does, specifically when discussin prostitution and child molestation. He just doesn't blatantly state his opinions like opebo does.

All Lewis said was "No." How does that compare to opebo?

The difference is -
a) the issue is very important to Opebo; it's fairly low on my list of priorities.
b) the motivation behind the position is also at least partly a different one.

I’d have voted to put him on the court, but I would have voted against him being elevated to Chief Justice.

Like Ginsburg he’s a very able litigator with a keen legal mind yet his political motives seem to me to have over come his commitment to the fair and balanced interpretation of the constitution at times.

Unlike Ginsburg he has not got the kind of record where he’d be unsuitable to sit on the bench, but at the same time the same reasons that would to my mind, preclude Ginsburg from sitting on the Supreme Court would prevent me from being able to vote for Rehnquist as Chief Justice, the balance of his approach or lack of IMHO would weight against him when it comes to elevating him to the position of chief justice, in a way that they would not have when he was a candidate simply as an assistant justice.
