Not necessarily. Currently law makes no provision for the resolution of tied elections, so unless the Assembly acts to rectify this, the Class I seat will fall vacant on November 3 in the absence of a duly elected senator. Constitutionally, this would be treated as an ordinary vacancy, meaning anyone could run in the ensuing special election.
