South v. Atlasia

[Mr. Reactionary]

On behalf of the South, we hereby petition the Atlasian Supreme Court to grant an immediate injunction prohibiting the federal government of Atlasia from carrying out or enforcing any provision of Executive Order 55:02, attached below as Exhibit A.

In a tyrannical and imperialistic manner reminiscent of Vladimir Putin, the President of Atlasia has lawlessly purported to steal a Southern State, Kansas, by executive fiat. We all know that this is a blatantly unconstitutional and frankly impeachable act of aggression that shocks the conscience.

Very recently, this Court, in binding precedent clearly determined:

Kansas shall be part of the Southern region until an amendment to the Federal Constitution passes and declares it shall be part of the Fremont constitution.

As clearly stated, Kansas is the South under the Atlasian Constitition. Absent an amendment, which never happened, an Executive Order can't supersede the Constitution. Period.

We therefore ask the Supreme Court to issue an order immediately enjoining the President, Attorney General, and any officer or employee of Atlasia from carrying out or enforcing Executive Order 55:02, any future Executive Orders purporting to transfer sovereignty or control over Kansas to a Region other than the South, any future Executive Orders purporting to exercise control over the Southern National Guard and unorganized militia, as well as declarative relief that Kansas is, in fact, the South, and Executive Order 55:02 is unconstitutional and thus null and void ab initio

The Southern legislature has approved legislation and the Southern Governor has signed legislation, S. 22.1-82, which provides for the declaration of war as a response to ambiguity over Kansas’ regional status. The enactment of this legislation creates a state of hostility between the Federal Government and the Southern Government, and creates the danger of a rebellion against the Government of the Republic of Atlasia. The existence of this legislation constitutes a conspiracy to resist legitimate, constitutional adjustments to regional boarders by means of violence, and to instigate violence against the Government of the Republic of Atlasia, the people of Fremont, and the people of Kansas.

NOW, THEREFORE, I, Oregon B. Dog, President of the Republic of Atlasia, under and by virtue of the authority vested in me by the Constitution and laws of the Republic of Atlasia, including Chapter 15 of Title 10 of the United States Code, particularly sections 332, 333 and 334 thereof, do command all Southern National guardsmen or unorganized militia to desist therefrom, and to disperse forthwith from the state of Kansas.

THEREFORE, in order the assuage the threat of rebellion, the state of Kansas shall be transferred to the control of the Commonwealth of Fremont

WHEREAS the commands contained in this proclamation have not been obeyed and the law remains a Southern statue and threatens to continue, and Kansas remains under Southern jurisdiction:

NOW, THEREFORE, by virtue of the authority vested in me by the Constitution and laws of the Republic of Atlasia, including U.S.C Chapter 15 of Title 10, particularly Sections 332, 333 and 334 thereof, and Section 301 of Title 3 of the United States Code, it is hereby ordered as follows:

Section 1.  Units and members of the Armed Forces of the Republic of Atlasia will be used to maintain peace in Kansas and to transfer control of the state of Kansas to the Government of the Commonwealth of Fremont


Section 2. The Attorney General is authorized to use such of the Armed Forces as may be necessary to carry out the provisions of section 1, to that end by virtue of the authority vested in me by the Constitution and laws of the Republic of Atlasia, I hereby authorize the Attorney General to call into the active military service of the Republic of Atlasia, as he may deem appropriate to carry out the purposes of this order, any or all of the units of the Southern National Guard to serve in the active military service of the Republic of Atlasia and for an indefinite period and until relieved by appropriate orders.

Our request asks for an injunction against future such orders as well as declaratory relief, neither of which is satisfied by the purported scheme to escape review. We again reemphasize our prior request, including a declaration that Executive Order 55-02 is unconstitutional and null and void ab initio as are future such orders. Such is all important in establishing our rights and preventing future conflict.

I am attaching Executive Order 55-03, which is identically worded to Executive Order 55-02 and is frankly a mockery of this Court and its authority. It is also why our initial request asks for an injunction against future unconstitutional orders, like EO 55-03. Rather than attempting to deescalate the situation after running the GM out of the game, respondants have doubled down on this illegal, Putinesque stupidity in a direct attack on the game itself.

To quote the GM on this matter:

For what it’s worth, I am a Frémonter – a proud one at that –, but I cannot and I will not justify trying to force an entire state and its citizens to be a part of the Commonwealth by force, particularly when it has been made clear – via currently canon events – they do not wish this. And I cannot and I will not carry on as GM when the highest authorities in the land feel free to justify dramatic actions by citing events that have not taken place.

Using the powers of the Federal Government to unlawfully invade a state against its will and without reasonable justification is, to put it mildly, a serious abuse of power. Some people may find it fun, I do not, and I want no part in it.

As concluded by the GM:

CLARIFICATION / CRISIS EVENT

Kansas

For the sake of clarify within the current situation in Kansas - and upon complaints - it is clarified that - and it can be ascertained from current posts thus far - the Governor of the South has not declared a state of emergency not mobilized the Southern National Guard out of his own authority. Present acts of resistance to Federal authority and/or intervention within the state of Kansas, including that of troops - which may have mobilized on the first place following the President's authority only to resist later - have not been legally sanctioned by the Governor of the South. This clarification should not, theoretically, contradict previously reported events.

In other words, the GM agrees that Atlasia is the instigator.

Finally, to quote AG Truman, who has violated direct Supreme Court precedent known to him:

2. A finding of criminal contempt against the Attorney General for willfully violating this Court's emergency injunction against illegally invading the South.

3. Disbarrment and monetary sanctions against the Attorney General for unethically and contemptuously violating a Court injunction in bad-faith.

Blood alone moves the wheels of history.

The insidious southern malefactors cannot deny their role in instigating the conflict. It is written in the blood of slaughtered Frémontian millions. It is written in the rock where the last word of the apocalypse will be revealed.

The struggle now engaged in the West is older than all the ages of the world. It is the struggle of order against chaos. It is the struggle of the striving human spirit which yearns, above all, to be free.

The war of the southern border ruffians against he people of the land was begun long before our people e'er saw Kansas. In those days, there were only two words which split the human family: conquered and conqueror, oppressor and oppressed.

The long-suffering spirit of the people, alive in the hearts of the poor farmers and laborers of the earth, proved more sturdy than the false doctrines of the princes and the empty indulgences of the Church. It carried them from Europe to a new land in America; when the power of the oppressor class grew great in the East, it carried them westward, beyond the fertile valley of the Cumberland, beyond the tempestuous waters of the Ohio, to a new home in the free West, and Kansas.

Those few brave souls who arrived on that soil in the bloody spring of 1856 came following an idea. They saw in the land a refuge from the cruel machinations of the East and the unnatural and unholy law of Slavery. They came by twos and threes, by dozens and then hundreds, in search of that idea of freedom promised to all the children of God in our nation's first and highest declaration of principles:

We hold these truths to be self-evident, that all men are Created EQUAL, —that they are endowed by their Creator with certain unalienable Rights, —that among these are Life, Liberty, and the Pursuit of Happiness.

But there were other ideas in those days. In the black hearts of the great men of the East, there lurked another, secret hope: an idea of empire.

The merciless border ruffians who descended on Kansas were sent the minions of a new power rising in the East: a Power who had avowed their ultimate goal from the halls of Congress and the pages of their gazettes. From Oregon to the Gulf of California, from the Panama Isthmus to the Ohio River, an empire for Slavery would reign over North America: and the masters of this domain, the cruel and conniving men of the East, would have achieved what their ancestors had dreamt: the final defeat of liberty, and the eternal subjugation of the human spirit to the jack boot of the restored feudal order.

The first stage would be in Kansas. Should Kansas fall, all roads to this future would be open and easy.

I hardly need recount the atrocities committed against Kansas and the West in service to this evil goal. Suffice to say the Slave Power was dealt a decisive defeat in 1865, at the hands of the Holy Alliance of northern and Western men, who stood together against the forces of tyranny and darkness. But the spirit of evil lingered in the South. In time, it would be resurrected as the Invisible Empire: its gospel carried by new ministers under the old flag, its legions poised and ready to strike, when the time was right, to begin again their eternal war on freedom and civilization.

Gentlemen, the hour is upon us. Gentlemen, the hour has come.

The actions of the southern mercenaries in recent days presage the coming of a greater conflict. They recall, to all literate and learned men, the outrages which preceded the First War of Southern Aggression.

By order of the southern emperor, southern troops have been mobilized against Kansas. Southern filibusters have been dispatched to our outlying Pacific states to raise the old standard of empire upon the woke claimed cause of "national liberation."

Can we ignore such outrages? Can we pretend not to recognize the unfurling imperial banner? Even now, the full might of the Invisible Empire is arrayed against us. Even now, the winds from the East carry words of daily atrocities committed against the free people of the West.

Southern paramilitaries have fired upon peaceful demonstrators in Kansas. Southern insurrectionists have planted bombs in the schools and churches of Kansas. Butchers of men, women, and children have targeted hospitals, the houses of the poor, railways, airports, and every venue sustaining public life.

The hireling press carries no news of these atrocities. Their lying editors, purveyors of fake news and  tabloid gossip to the masses, seek deliberately to silence all word of what is happening all across the Transmississippi. Such deceit and mass-manipulation on the part of the prided fourth estate is unknown since the days of Goebbels. It represents the massive commitment of the mercenary press to the cause of southern domination and the Invisible Empire.

Frémonters, will we be silent? Will we allow this reign of terror to proceed unanswered?

Even now, even hours ago, the Invisible Empire sought to forestall their inevitable doom. On the steps of this capitol, not fifty yards from where I now stand, the hireling thieves of this desperate conspiracy made a cowardly and despicable attempt on my life. By the grace of God I have survived to tell you tonight that Frémont will not submit, will never submit, to the forces of evil, even if every son of the West must lay down their lives in defense of our liberty and the sanctity of our homes and firesides.

We will not, like the preening Buchanan, allow the spectacle of peace to continue until the Invisible Empire is armed and ready to strike. As they have sought war, we will carry the battle to them.

By the authority vested in me by the president, I order all units to liberate and occupy the Transmississippi, by land, by sea and air, and every avenue of advance, until the flag of Frémont flies over all the free lands of the West.

In this struggle, we have the support of the loyal and patriotic governments of the Transmississippi states: our brothers and sisters in Arkansas, Louisiana, Missouri, Oklahoma, and Texas. Their armies I now place under federal control, and order to mobilize to secure their states against southern aggression.

In this struggle, we shall not flag or fail. We shall go on to the end.

It is the southern fascists who have made this hour. They will now reap the harvest of their false words.

We will have peace. We will have liberty. We will have law and order.

Whereas the successful prosecution of the war requires every possible protection against espionage and against sabotage to national-defense material, national-defense premises, and national-defense utilities as defined in Section 4, Act of April 20, 1918, 40 Stat. 533, as amended by the Act of November 30, 1940, 54 Stat. 1220, and the Act of August 21, 1941, 55 Stat. 655 (U.S.C., Title 50, Sec. 104);

Now, therefore, by virtue of the authority vested in me as President of the Republic of Atlasia, and Commander in Chief of the Army and Navy, I hereby authorize and direct the Attorney General and the Military Commanders whom he may from time to time designate, whenever he or any designated Commander deems such action necessary or desirable, to prescribe military areas in such places and of such extent as he or the appropriate Military Commander may determine, from which any or all persons may be excluded, and with respect to which, the right of any person to enter, remain in, or leave shall be subject to whatever restrictions the Attorney General or the appropriate Military Commander may impose in his discretion. The Attorney General is hereby authorized to provide for residents of any such area who are excluded therefrom, such transportation, food, shelter, and other accommodations as may be necessary, in the judgment of the Attorney General or the said Military Commander, and until other arrangements are made, to accomplish the purpose of this order. The designation of military areas in any region or locality shall supersede designations of prohibited and restricted areas by the Attorney General under the Proclamations of December 7 and 8, 1941, and shall supersede the responsibility and authority of the Attorney General under the said Proclamations in respect of such prohibited and restricted areas.

I hereby further authorize and direct the Attorney General and the said Military Commanders to take such other steps as he or the appropriate Military Commander may deem advisable to enforce compliance with the restrictions applicable to each Military area here in above authorized to be designated, including the use of Federal troops and other Federal Agencies, with authority to accept assistance of state and local agencies.

I hereby further authorize and direct all Executive Departments, independent establishments and other Federal Agencies, to assist the Secretary of War or the said Military Commanders in carrying out this Executive Order, including the furnishing of medical aid, hospitalization, food, clothing, transportation, use of land, shelter, and other supplies, equipment, utilities, facilities, and services.
