It should be heavily regulated by the state to ensure minimum standards are being met. I don't know how this would be enforced- testing, I imagine. I would think setting up a cooperative school might be a preferable alternative in many circumstances, in terms of resource pooling and regulation.
I know people who have been homeschooled due to sheer isolation- that at least should be legal.
