Timeline Cont.

8:22 P.M.  Secretary of State Clinton boards a plane bound back to the United States.  She releases a brief statement at the airport, condemning the reports and noting that her husband was among those in attendance.  She is obviously shaken.

8:24 P.M.  The United States military lands helicopters around the Capitol Building and the White House.  Washington D.C. is under military control.

8:29 P.M.  A federal judge rules that the "Designated Survivor" is constitutionally the Acting President of the United States until survivors can be sorted out.

8:30 P.M.  Secretary of Health and Human Services Kathleen Sebelius is declared Acting President, and immediately grounds all commercial aircraft in the United States.  She raises DHS alert level to red, and the DEFCON level is raised to 3.

.[/i][/center]

Secretary of State Hillary Clinton would immediately assume the powers of the Presidency. The "designated survivor" is not the next in line to the Presidency. Clinton was the defacto designated survivor by not being in the country.

Not entirely true.  Clinton was out of the country during this year's State of the Union, and there was still a Designated Survivor.  Sebelius was the only person that was close to the action and could act, so she was declared Acting President.  Once Clinton was able to assume the role, she did.

Clinton would have still succeeded the Presidency. In the digital and information age, Clinton is capable of managing from afar or appointing someone on the field to manage.

My point still stands, Clinton was defacto designated survivor even with a random person staying home and watching it on TV. It would be unconstitutional to swear in Sebilus when Clinton is clearly alive.

I don't know, I kind of morbidly like the "sh**t Hits The Fan" situation. Very interesting.

Positive: I do too. Lets see what happens.

Idea: Clinton gets emergency powers and extends her term?

Criticism: With nukes flying and NYC gone...the US would be in DEFCOM 1...I think the murder of millions of citizens qualifies as that...

No.  If the President-Elect and Vice President-Elect cannot take office, the Congress votes for their replacements.

I'm gonna start a new TL soon, starting in 1892 and continuing to today.  This was my first TL, and I'm losing interest.  I'm probably gonna speed it up.

I think your vote for a new President was messy and possibly unconstitutional but whatever floats your boat

It was intentionally messy...I think I made that pretty clear.

Section 3. If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.

Section 4. The Congress may by law provide for the case of the death of any of the persons from whom the House of Representatives may choose a President whenever the right of choice shall have devolved upon them, and for the case of the death of any of the persons from whom the Senate may choose a Vice President whenever the right of choice shall have devolved upon them.

Don't accuse me of not doing me research.

I'm not saying you didn't do the research. My doubts were  that I would have initially thought the House would vote in-bloc for the President if the circumstances arose just as if there is no majority in the electoral college.

Clinton also wins in the House by a plurality, you never said the Democrats got their act together and voted by the majority that they have.
