It's not a ban on being out at night or driving to work.  You've just got to have a place to go or something to do.  It's a perfectly reasonable response to the recent events and local news coverage makes peoples' reactions seem tame if not ok with it.

I wasn't aware that loitering at 3 in the morning was a right of the legal process.

If I want to sit on my porch at 3 am what business is it of anyone else?

Again, that's not what the curfew does.
