If RBG replacement gets confirmed and seated at the court before the election or after, despite Biden winning, I think the big takeaway is that SCOTUS nominations are only permitted when the prez' party controls the senate. Otherwise, there is just no confirmation, no matter how far the current term of office has progressed.

Yep we’re packing the courts. If Republicans are gonna blatantly disregard decorum and their own precedents, then we have no reason to treat them like a legitimate governing party. Add 2 justices to the SCOTUS and admit DC & Puerto Rico to the union and add 4 Democratic Senators.

I'm not sure Dems have the guts. But they should absolutely do it now. And impeach Barr to drag it on. Enough with playing it nice.

I'm still eagerly waiting for any Republicans here to tell me why a Saturday Night Massacare participant should be on the Supreme Court.

For the same an anti-intellectual, cheating orange clown should be in the WH.

ACB met with Trump yesterday (Thursday). She will now have to go into quarantine for 14 days no matter if she tests positive for COVID-19 or not. Republicans might not be able to get her on the Supreme Court before the election.

If the confirmation fails due to this, it would be a huge irony. But couldn't they just interview her by video. I'm not sure the senate rules require personal testimony or whether they could change said rules.

There is little doubt she'll be on the bench by Halloween. Unless there is another COVID-19 outbreak or so, this is going to happen 100%. Dems were really screwed SCOTUS in past 4 years.

Yup, we have to pack the court. And my take is that Biden is likely to do/attempt to do so. I think the commission he intends to set up is more of an attempt to raise acceptance for such a step by putting a different set of people on it.

The GOP for years has trashed institutional norms and created a climate of hyper partisanship. It started with Gingrich and peaked under Obama, when they gave him a big middle finger for every reasonable policy he wanted to pass. Now they have stolen 2 seats from the bench, having appointed 5 out of 8 justices since 1993, but only won the NPV once since then. They are weaponizing the federal judiciary to ram through their unpopular agenda because they can't pass it in congress. Now they have ZERO rights to complain about "assault on institutions" of Dems pack the court with at least 2 seats to restore some balance. It isn't even an attack on institutions, since congress has the right add seats. If the 117th congress wants to do so and said bill becomes law with Biden's signature, that's legitimate process. And as prez, he has the right to name additional justices with approval of a Dem-controlled senate.
