In an alternate universe, Richard Nixon’s conspiring with Anna Chennault to derail LBJ’s attempt for a Vietnam ceasefire is revealed prior to Election Day and results in a Humphrey presidency.

Arthur Goldberg is nominated to replace Earl Warren as Chief Justice.

Homer Thornberry is renominated by Humphrey after Abe Fortas resigns (as in our universe).

After the death of Hugo Black and the resignation of John Marshall Harlan in September 1971 (as in our universe), Archibald Cox and Shirley Hufstedler are nominated/confirmed.

Humphrey/Muskie are re-elected in 1972 (the economy is doing well and detente with the Soviets is popular.  Humphrey negotiated withdrawal of American forces from Vietnam by 1970).

William O. Douglas resigns in 1973 and is replaced by Attorney General Ramsey Clark.

In 1976 Howard Baker defeats Edmund Muskie for president.

In 1977, Potter Stewart resigns and is replaced by Lewis Powell.

The Court in 1978:

William Brennan
