Question about the voting procedure

The following situation (this may NOT apply to Americans or those using touch-devices):

When you are voting in the voting booth, there is usually a ball-pen in there.

I have often seen that the ball-pen for voting is either "red" or "black", like the official party colours.

What do you think ?

Should it be legal that the pens can have the colours of the parties, for example blue for the Dems and red for the GOP or black for the ÖVP and red for the SPÖ, or should they be mandated to only use transparent pens ?
