Considering that a lot of people have been killed in drunk driving accidents, jail time is more than reasonable. The laws aren't structured good enough to even be a deterrent to someone getting behind the wheel drunk.

I think New Mexico does it best, first offense is a fine plus a breathalyzer installed in your car required for a start. This means people can still get to their jobs and all easily yet are guaranteed to not be a threat to others. I understand NM also has a lower recidivism rate on this than most states as well.

Given the near ubiquity of needing cars to get places, having some way of getting from place to place after a DUI is needful.  A breathalyzer interlock is one way.  South Carolina has taken a different path than New Mexico.  Since one does not need a driver's license to drive mopeds upon the public roads in this state, they have acquired the nickname of DUI-mobiles.  You're still a potential danger to yourself, but at least if you get in a crash you aren't likely to hurt anyone else.

Yes, and rightly so by the way.
But it's only slightly  above what the legal limit in this country used to be not so very long ago, and the notion that it's some kind of capital crime that deserves *years of* jail time is... uh... out there with the notion that marijuana possession deserves jail time.

There's a lot of things that are rightly forbidden and that still are not dreadful horrible crimes. Fine him, take his license away for a few months maybe.


I'm not saying that at all, I'm just saying it's totally reasonable that driving under the influence is illegal and can come with jail time. That's common sense.
You need to bite that bullet to retain a logical position.
