Racially discriminatory laws are examined by the courts with a strict scrutiny test. Is the legislation that discriminates on the basis of race narrowly tailored to achieve a compelling governmental interest? If it isn't, then it gets struck down. What would be the compelling reason to tax white people worse than black people?
