Should Justice Breyer step down from the court during the next two years while Biden is President and Democrats hold the Senate? In my opinion, particularly after the lesson learned with RBG — may she Rest In Peace — yes, it would be a travesty if he doesn’t.

This is a good point. Replacing old circuit and appellate court justices with young new appointees while we hold the senate may be our only chance to diminish the damage done to the judiciary during Trump’s presidency.

Yes, and there's a decent argument he should do it immediately on the 21st and not wait to the end of the term because of how unstable a 50+VP/50 senate majority is.

Telling her to step down wouldn't be unprecedented. McConnell told dozens of W. Bush appointees around that age to step down.

Yes. He's a great justice, but obviously he needs to retire to allow Joe Biden pick a successor. Hopefully Joe Biden also gets to replace a conservative judge, especially Alito and Thomas.

No, with our Senate lineup in 2024, D's have a strong chance to win in 2024, RBG had Pancreatic cancer and from taking care of my mom, Pancreatic cancer affects the way you sit, and it affects the way you hear cases. Breyer has no reason to step down

He's not stepping down, he is healthy, Kennedy only stepped down as a favor to Trump, he was healthy too

It would be good to step down as soon as possible, pending confirmation of the replacement. Dem's control is knife edge, a death in the wrong state and they could be in the minority again.

Yeah, but the way that went down sort of demonstrates that when Obama was elected she should've taken what she could get. Better to have a 100% chance of a like-minded successor than a coin flip between a symbolic victory and a racist reality TV star appointing some handmaid's tale type justice to completely demolish your legacy.

No? That means nothing.

1. Garland was Obama's choice. While very close, Biden might want to pick someone else

2. Garland was a compromise, Obama hoped he would be the one judge senate republicans could stomach. Now he is free to do as he pleased

But I do think he should retire.
