Trump v United States absolutely kills this case, just a question of how long it takes. Judge Merchan will painstakingly waste his time trying to apply the incoherent "logic" of that case to the facts here and will either find that the case needs to be dismissed, or it'll be appealed and eventually reach SCOTUS on those grounds, who will decide for Trump, because that's their predetermined outcome.

It's crazy that we're talking about this like there was some sort of rationale behind Trump v US that can be consistently applied. There's not. The majority wanted Trump to have immunity so they put together a barely coherent stream of consciousness where the Constitution and law where never even considered. That's the legal principle at play for presidential immunity: figure out what would help Trump, and then do that. Any act Trump has committed in his life will be deemed an official act because that's the outcome John Roberts wants and there's nothing that's going to stop him.

As far as I'm concerned, if the Supreme Court can do all that, Merchan needs to do the same, tell them to f*** off, and throw Trump in Alcatraz. Justices can seemingly do whatever rhey want these days, and sane Justices should not unilaterally disarm.

I’m not worried that Merchan will vacate the conviction or even rule for Trump on any of this.  My biggest worry is that he will rule against Trump but continue to delay the sentencing until after Trump can appeal this ruling, which would certainly move it until after the election.

^ That's probably likely that he will suspend the sentence until it is appealed (in the NY system, not to SCOTUS). So yeah he's probably not going to face the sentence until after the election.

An advantage of that though, is that if he wins, the appeals will be done by the time his term ends, and the sentence will be right there waiting for him.

I think, given the complete self-destruction of the Democratic Party, Marchan would be smart to set aside the verdict and declare a mistrial. Then refuse to schedule a new trial close to the election. That way he gets his reputation back and doesn't become a target of any retribution that may happen.

Dumb and incorrect for several reasons.

Merchan's reputation has not been damaged in the eyes of anyone except Republican hacks.

Nothing will stop Trump from trying to enact retribution against Merchan.
