In 2008

Supreme Court Associate Justice Antonin Scalia of New Jersey is prevailed upon by the Republican Party to step down from the High Court to accept the Republican Presidential nomination.  Scalia agrees.

Scalia picks Senate Judiciary Committee member Senator John Kyl of Arizona for Vice President.

Likewise, the Democratic Party asks Supreme Court Associate Justice Stephen Breyer of California to leave the High Court to run for President as the Democratic nominee.  Breyer agrees. 

Breyer picks Senate Judiciary Committee chairman Senator Patrick Leahy of Vermont for Vice President.

No other candidates run in the election.
