I don't in my counts (I treat them as superdelegates), and I assume Hillary will make the same argument.

She can, but she's still not getting a majority of delegates under any count. Unless she uses the Hillary is 44 hacks case that not a single delegate from Michigan should count for Obama (even the ones pledged to him later.)

Which she's free to, but I have a tough time seeing that convince a single superdelegate. Worth mentioning now that when people present contrived arguments that Hillary can use to argue she's actually won, they're basically assuming that the remaining superdelegates are the stupidest people on Earth (if they believe that these arguments can persuade the number of them Hillary needs to win that is.)

It's also notable for how he basically just gave the middle finger to his state.

Seriously though, can you imagine the backlash if he didn't endorse Obama? Plus Obama is the more logical candidate for him anyway, considering how strongly Byrd is opposed to the Iraq War.
