Essentially this is the much speculated ramshackle coalition of five that won't hold together for all votes vs. four men with actual brain worms.

Reading the dissent, even Alito was unwilling to engage with this case on the merits, instead he spends his opinion huffing and puffing about procedure: https://www.supremecourt.gov/opinions/24pdf/24a831_3135.pdf

Disappointing, but Trump has almost four years to end judicial tyranny.

If anything, Trump is the cause for "judicial tyranny" because he appoints Federalist Society judges.

Why bother engaging? There's no intelligent reason to defend Trump anymore and therefore no intelligent person is going to do it. The sooner trolls like ShadowOfTheWave are starved of attention, the sooner he has to leave his bedroom and reevaluate his life choices.

The real story here is that four Injustices dissented. I'll give Sotomayor my kidney if I have to.

Miers was (hilariously) chosen without input from the Heritage Foundation or Republican senators. She arguably got harsher criticism from Republican senators than Democrats, bc they didn't want to waste a SCOTUS seat on an unqualified unknown! She was never making it out of Committee regardless of what Dems thought, hell Lindsey Graham and Sam Brownback were the two Senators who finally forced her withdrawal by requesting confidential executive memoranda.
Looking back it does seem so Trumpian, meanwhile in comparison Trump has been remarkably constrained by the Heritage Foundation with his judicial picks.

The problem is Heritage Foundation judges themselves becoming more Trumpian, notably on including a few on the Supreme Court itself but even more so with the lower courts.

Trump appointed some absolute right-wing trolls to the lower courts in his first term (and he’ll appoint more in this one with his comfortable Senate majority), but radicalization has been a problem with the American Right for a while and if anything is getting demonstrably worse with the rise of this younger, Very Online generation. And well, the law students, clerks, and newly-appointed judges with Federalist Society membership, by definition…
