The House Judiciary Committee votes to recommend Attorney General Merrick Garland be held in contempt of Congress for not turning over an audio recording of President Joe Biden's interview with the special counsel who investigated his handling of classified documents.

Biden cites executive privilege as reasoning for not turning over the audio.

In terms of optics though, not turning over the audio looks bad. We already have the transcript of the entire interview - so, why not release the tape, too?

Biden has been fighting an image problem of being a doddering old man. The only reason not to release the audio would be because it doesn't make him look good. If that's no issue, denying it looks bad.

Biden asserts executive privilege over Hur audio files ahead of House contempt proceedings against Garland

Quote
President Joe Biden has asserted executive privilege over the recordings of his interview with special counsel Robert Hur, according to letters from the White House and Justice Department to House Republicans.

Republican lawmakers had previously subpoenaed the audio recordings of Biden’s interviews, along with his ghostwriter, Mark Zwonitzer and other items from Hur’s investigation into Biden’s handling of classified information. The House Oversight and Judiciary committees are scheduled to begin the process of holding Attorney General Merrick Garland in contempt of Congress for failing to comply with those subpoenas on Thursday.

“Because of the President’s longstanding commitment to protecting the integrity, effectiveness, and independence of the Department of Justice and its law enforcement investigations, he has decided to assert executive privilege over the recordings,” White House Counsel Edward Siskel wrote to House Oversight Chair James Comer and House Judiciary Chair Jim Jordan.

So it doesn't get clipped into ads, lacking context and possibly heavily edited. Right now all they have is text.

But you see how this is a lose-lose, right?

Release it and have it chopped into ads and edits of moments where he is forgetful.

Don't release it and have people wondering what he's hiding.

If I Team Biden, I'd release it, and get ahead of any gaffes. "What you're hearing is a man discussing sensitive issues, such as the death of his son. Questions that no grieving father should ever be asked. Questions that had no bearing on the whereabouts of documents, but which were asked by a partisan special counsel with the hopes of biasing an investigation."

Release it, and get way ahead of every possible negative ad and angle. Be on TV 24 hours a day, 7 days a week if you must running defense and getting ahead of any moment that looks bad.

That's the problem with the Biden White House - they never get ahead of a story. They never get ahead of a narrative. They spend their time responding to the narrative once it's already been constructed, rather than getting ahead of the ball and shaping it themselves.

I think Garland should certainly comply, as soon as all present members of Congress have complied with any outstanding subpoenas against them.

Garland should receive the same treatment as Peter Navarro if he fails to comply with the subpoena.

The tape of Biden's interview with Robert Hur is not a matter of Executive Privilege.  The people have a right to see their President respond to the questions asked, and they should be able to make up their own mind as to his level of cognitive functioning, given Hur's comments as to not charging Biden due to his forgetfulness.

Biden possessed classified documents he had no right to, and, unlike Trump, he had no power to declassify them.  He did this for decades.  The elements of the crime were met, and the idea that Biden "cooperated with the National Archives and investigators is beside the point; the cooperation was, in Biden's case, decades too late.

The American people are entitled to see this, regardless of the effect it may have on the Presidential election.
