Simple question because deep fakes can be used to humiliate, blackmail and more. You're essentially able to make videos of innocent people saying or doing things that aren't "ok". Which is why I don't think banning it would be a first amendment issue since (unwarranted/false) defamation and libel aren't protected and these easily get into the realm of defamation if say you have a video of someone saying some really awful sh**t or a video of a girl in a porno. The latter would be a form of revenge porn no?

I'd like to see your takes on this.

Yes but it would need a very high bar a la defamation, AND it should only be able to be sued if the defendant clearly intended to mislead people (so didn't say it was a deepfakes or anything).

I think that at some point, there will be a legal distinction between videos that VERY CLEARLY indicate that what you're watching is a deepfake (permanent watermark in every frame?) as compared to other deepfakes. Basically, "what you watching isn't real" being CLEARLY shown would have either no legal ramifications, or at least lesser legal ramifications.
