ELECTROSHOCK VICTIMS JUSTICE ACT

1. The Electroshock Therapy Ban Act shall be amended as follows:

1. The therapeutic use of electrical stimulation devices for corrective behavioral therapy, including but not limited to the graduated electronic decelerator and the self-injurious behavior inhibiting system is hereby prohibited in Atlasia.

2. The Attorney General is hereby authorized and requested to investigate the Judge Rotenberg Center in Massachusetts for the unlawful violation of constitutional rights.

3. A person who performs the therapeutic use of electrical stimulation devices for corrective behavioral therapy in violation of this act shall be liable to the individual if injured (including any physical, psychological, emotional, or physiological harms) by such procedure, related treatment, or the aftereffects of the use.

4. An individual eligible to sue may, not later than the day that is fifteen (15) years after the date on which the individual turns eighteen (18) years of age, regains mental capacity, or otherwise becomes eligible to sue, bring a civil action against such physician in a court of competent jurisdiction for:

A. declaratory or injunctive relief;

B. compensatory damages;

C. punitive damages; and

D. attorney’s fees and costs.

Right now there is no right to sue. This creates a right to sue and extends the SoL back 15 years to allow for lawsuits.

It's great that it's establishing a right to sue, but the statute of limitations needs to go.

Huh. I should say something here, shouldn't I?

Yes, ladies and gentlemen, as promised: to complement the electorshock therapy ban that was sponsored by former Senator Enduro, this bill extends the statute of limitations for victims of wrongful treatment by institutions such as the Judge Rotenberg Center that have long histories of abuse which led to multiple fatalities. It is only due to a loophole in our regulatory code and the established legal lack of ability for the FDA to regulate, that this center is allowed to exist and continue with its harmful practices, in the name of a fruitless search for an autism "cure."

I'm not sure if it's practical, however, to not include a statute of limitations. We are extending existing patient protections, and zero statutes of limitations are generally reserved for the most heinous crimes, such as first-degree murder. Reactionary can perhaps shed more light on that. But this is a necessary bill and I implore our senators to vote on the side of justice for all.
