LINCOLN REFERENDUM AMENDMENT

To the end of the Constitution, add the following new article.

Article IX: Referendums

1. Certain legislation may be subject to the full authority of the eligible voting populace through regionally sanctioned referendums.

2. Referendums are to be sanctioned under any of the following methods:

a.) Citizens may submit legislation under the Lincoln Legislative Introduction Thread with the expressed intent that it be reviewed as a potential referendum. It shall be presented to the General Court for their approval (a direct deputy sponsor is not required). A two-thirds majority shall be required to authorize the referendum.

b.) Upon the veto of a bill by the Governor, the General Court shall have the right to request that the legislation be forwarded to the Lincoln populace in lieu of a veto override. A two-thirds majority shall be required to authorize the referendum. Once a referendum is authorized, a veto override on the particular legislation is no longer possible.

c.) The Governor, in lieu of a declaration in favor or in opposition, or a redraft, may instead defer any passed legislation to the Lincoln people's judgment at personal discretion.

3. Any referendum authorized under this article shall be held concurrently with the next regularly held election, which may be a special election.

4. Referendums are to be considered as passed should they receive a majority of votes in favor. Abstentions shall not affect the results. Implementation is to occur immediately following certification unless otherwise noted in the text.

PRISONER SECOND CHANCE ACT

TITLE I: PRISON WORKERS

1. Any prison in the Lincoln Region may operate a prison worker program to utilize the voluntary labor of prisoners for productive ends. Such program shall be open to any willing, able-bodied prisoner not determined to be a flight or safety risk. Participating prisoners may be assigned or authorized to perform any job permitted by this act. Prisoners who participate in such program shall be compensated at a pre-determined rate up to twice the minimum wage.

2. Any person actively participating in a prison work program may be employed to perform basic tasks necessary to the operation of the prison such as maintenance and upkeep, laundry services, and food preparation and distribution.

3. Any person actively participating in a prison work program may be employed to serve on a work crew performing basic maintenance and upkeep upon the streets, sidewalks, sewers, parks, buildings, or other public grounds and works of a governmental entity.

4. Any person actively participating in a prison work program may be employed to work on an on-site prison farm or an on-site quarry.

5. Any person actively participating in a prison work program may be employed to serve in the militia.

6. Any person actively participating in a prison work program may be employed to perform basic manufacturing services on behalf of a governmental entity such as vehicle license plates, pauper's coffins, or office furniture.

7. The prison worker program shall operate, or contract or coordinate with providers of job training and skill courses that train potential workers in skills and trades necessary or advantageous to finding stable employment. Such job training and skill courses shall prioritize jobs facing a critical shortage of workers as determined by the governor; provided that such priorities shall include the construction trades, commercial vehicle operation and repair, aviation piloting and repair, computer programming and repair, and the manufacture or repair of critical infrastructure and critical supplies.

TITLE II: PRISONER REHABILLITATION

1. Any person in the Lincoln Region completing a term of imprisonment exceeding one (1) year in length shall be required to participate in a prisoner reentry program for no less than two (2) years upon release or for the duration of any parole or probation period, whichever is longer. Such program shall be designed to reduce recidivism and promote successful reentry by former prisoners into society. Failure to successfully complete the prisoner reentry program may result in a parole or probation violation and shall be reported to any court as character evidence at sentencing in the event that a former prisoner is convicted of a new crime within five (5) years of being released from a term of imprisonment exceeding one (1) year.

2. $1 Billion is hereby appropriated to carry out this title.

3. Any person actively participating in a prisoner reentry program shall be required to participate in an appropriate treatment program that includes counseling on criminality and recidivism.

4. Any person actively participating in a prisoner reentry program shall be required to attend an appropriate course on civic education to promote good citizenship, Regional patriotism, and successful reentry into society.

5. The prisoner reentry program shall operate, or contract or coordinate with providers of job training and skill courses that train potential workers in skills and trades necessary or advantageous to finding stable employment. Such job training and skill courses shall prioritize jobs facing a critical shortage of workers as determined by the governor; provided that such priorities shall include the construction trades, commercial vehicle operation and repair, aviation piloting and repair, computer programming and repair, and the manufacture or repair of critical infrastructure and critical supplies.

6. The prisoner reentry program shall operate, contract with, or coordinate with  job location services, employment offices, hiring halls, and other service that identify potential jobs and employers in the area and potential workers for such jobs, and connects, coordinates, or facilitates the potential employment of such workers, employers, and jobs.

7. The prisoner reentry program shall operate or contract or coordinate with providers of behavioral and mental health counseling services that are necessary to successfully reintegrate former prisoners into society.

8. Any person actively participating in a prisoner reentry program shall be evaluated to determine if the person is also eligible for any other federal, Regional, or State welfare program or benefit. If the evaluation determines that such person is eligible for other programs or benefits, the reentry program shall offer to assist the person in applying for such program or benefits. If after thirty (30) days of notification the person is still participating in the reentry program, has not applied for such program or benefit, and has not expressly refused to participate in the program or benefit, then the reentry program shall, to the best of its abilities, apply for the program or benefit on the person's behalf.


TITLE III: ENACTMENT

1. This act shall take effect five (5) days after the date of passage.

Not sure where citizen proposals for bills go, but I have one.  To wit:

SECTION I. BILL NAME

This bill may be known as the "Gun License Defense Act".  


SECTION II. DEFINITIONS

 (a) "Gun license" means any permit, license, or other authorization issued by a government agency allowing an individual to possess, carry, or use a firearm.

 (b) "Licensee” means the holder of a “gun license”.  

 (c) "Review” means any legal proceeding where a “gun license” is at risk of being suspended (either temporarily or permanently).


SECTION III. GENERAL FINDINGS

The General Court finds as follows:

 (a) Regional law allows for the temporary or permanent suspension of an individual gun license by local and regional courts of law (Section D of the “FF Act”; Title 9 Section 4 of the Consolidate Laws of Lincoln).  


SECTION IV. PROVISIONS

 (a) Any licensee may, upon review in a court of law, appear before the court in defense of the license.  

 (b) Nothing in this Act precludes making such a defense by telephone, virtual meeting session, or any other means which licensee and court mutually find to be appropriate.  

 (c) In all cases involving review, the court shall give notice (or reasonably attempt to give notice) of such to licensee within forty-eight (48) hours of scheduling such a review.  


SECTION V. SEVERABILITY

If any provision of this Act or its application to any person or circumstance is held invalid, the remainder of the Act or the application of the provision to other persons or circumstances shall not be affected.


SECTION VI. ENACTMENT

This Act shall take effect immediately upon its passage into law.

Discriminatory Training Ban

To ban divisive race theory training. This is a reintroduction of previously repealed LGC 9.16.

Section I. Prohibition

i. Any Lincoln government agency, or an agency of state or local government, or Business or School operating within Lincoln, may not use diversity training or education which promotes racist concepts, to be defined as the following concept or a substantially similar concept, that “any individual should feel discomfort, guilt, anguish, or any other form of psychological distress on account of his or her race or sex.”
ii. Sex shall be defined to refer both to one's classification at birth and their current preferred identity.

Section II. Enforcement
i. Any worker or student (or a parent of such a student) who is subject to this prohibited training or education can whistleblower to an appropriate manager or to an appropriate agency of local, state, or regional government.
ii. Any such manager receiving information from such a whistleblower should report it to an appropriate agency of the local, state, or regional government.
iii. Local and state governments will refer such reports to the regional government.
iv. The regional government shall pay the whistleblower a reward of $3,000. Where possible, this should come out of funds that would otherwise have gone to the state, locality, school district, school, or business authorizing the prohibited training or education.
v. Whoever originally ordered the deployment of the training or education within the business, government agency, school district, or school in question, shall be subject to a fine of $3,000, payable directly to the regional government. A third or subsequent offense may result in up to 60 days imprisonment as well as the fine. 'Originally ordered' refers only to the original person who authorized the training or education wherever it is used, and does not refer to a lower manager, official, teacher etc. following orders from a supervisor.

(a) In general. —

A licensed or certified health care practitioner acting within his or her lawful scope of practice may perform an abortion when, according to the practitioner's reasonable and professional judgement that —
(1) the patient is within twenty-four weeks from the commencement of pregnancy; or
(2) there is an absence of fetal viability; or
(2) (3) the abortion is necessary to protect the patient's life or physical health.


(bc) Protections. —

When any person has had a judgment entered against them, in any region where liability, in whole or in part, is based on the provision for reproductive health care services that are permitted under the laws of this region, such person may recover damages from any party that brought or sought to enforce the action leading to that judgment.

(1) Recoverable damages shall include:
(i)Damages created by the action that led to that judgment.
(ii)Expenses and attorney's fees spent in defending the action that resulted in the judgement's entry.

(2) Medical records and communications related to reproductive health may not be released without written consent of the patient or patient's legal representative.
(i)This shall not be construed to impede the sharing of medical records as permitted by regional or federal law.

(3) No judge or court justice may issue a subpoena requested by a commissioner appointed according to the laws of any other region or government when that subpoena related to reproductive health care services that are permitted under the laws of this region.

(4) No judge may issue a summons in a case where prosecution is pending, or where a grand jury investigation has commenced, for a criminal violation involving reproductive health care services that are permitted under the laws of this region.[/b]

(5) No Part of this legislation shall be construed to prohibit the prosecution for the provision of any service within Lincoln prohibited under the laws of Lincoln, or to allow Lincoln to take jurisdiction over the laws of any other region, or to ignore the lawful extradition order of another region.

(6) Except for use in Abortions, legally performed, in cases of rape, incest, or life of the mother, the Lincoln Government shall not accept any federal money designed to fund the performance of abortions. Nor shall it re-direct other federal funds, or use its own funds, to fund the performance of abortions, except in the three cases just noted. This shall not be construed to deny the citizenry the right to obtain and provide abortions legal under Lincoln statute, it merely mostly prohibits the use of federal or regional government funds in doing so.



Section III: Implementation

1. This act takes effect 60 days following signing by the Governor.

This bill will create a Lincoln Hall of Fame Museum of notable politicians, athletes, musicians and other celebrities who had a positive impact on Lincoln. This will be constructed next to the Capitol.

OK, I have an idea for a bill.  The problem is, I'm not sure if it's totally applicable here; it depends on which state's laws we are using for certain statutes/topics not already covered in the Lincoln Code of Laws. 

Anywho, if we're using New Jersey law for that precedent, this works as a submission.  If not...hey, it's the idea that counts, LOL.

Concerning the maximum sentence for the crime of unlicensed broadcasting.



SECTION I. BILL NAME

This bill may be known as the "Reduced Penalties for Unlicensed Broadcasters (REPUB) Act". 


SECTION II. FINDINGS

The General Court finds the following:

 1. The laws of the State of New Jersey forbid any person from making “a radio transmission of energy…unless the person obtains a license, or an exemption from licensure, from the Federal Communications Commission pursuant to 47 U.S.C. s.301, or other applicable federal law or regulation”. 

 2. Under this law, violators are “guilty of a crime of the fourth degree”, and thus may be sentenced to up to eighteen (18) months in jail (with a nine (9) month presumptive sentence).  (Reference New Jersey Legislative Statutes 2C:33-23.1-2)

 3. By precedent, this law is applicable on a region-wide basis. 

 4. The Region has a compelling interest in the promotion of free speech, whether on or off the air. 

 5. Restrictions such as the one at issue serve to undermine the cause described in Clause 4. 


SECTION III. PROVISIONS

 1. A person who engages in unlicensed broadcasting shall be liable for conviction of a misdemeanor crime.

 2. Notwithstanding any other provision of law, the maximum sentence for a conviction under this statute shall be imprisonment for a period no more than twelve (12) months, with the maximum possible presumptive sentence being no more than six (6) months.


SECTION IV. ENACTMENT

This Act shall take effect immediately upon its passage into law.

Better Business Practices Act

1. Except for purposes of compliance with any federal mandate, No employer in the Lincoln Region shall be permitted to ask any current or potential worker about his or her COVID-related vaccination status, nor shall such employer be permitted to retaliate against any current or potential worker for declining to offer or provide such information.

2. No court in the Lincoln Region shall enforce any nondisclosure or nondisparagement clause concerning sexual misconduct if such clause was entered into before the dispute arises.

3. The authority granted by Sections II-3 and II-5 of LGC 10.17 shall provide the government authority to enact and enforce the following, and be limited to such authorities:

a. Any Pharmacy Benefit Manager (PBM) in the Lincoln Region shall be required to publicly disclose complaints made against the PBM within 24 hours of the issuance of any complaint.

b. Any company that markets or sells prescription drugs in the Lincoln Region shall be required to publicly disclose any price increase no less than thirty (30) days prior to such increase along with an explanation for such price increase.

c. No company that markets or sells prescription drugs in the Lincoln Region shall be permitted to enter into any agreement with a doctor, pharmacist, PBM, or insurance company prohibiting such person from mentioning lower-cost generic drugs.

d. No company that markets or sells prescription drugs in the Lincoln Region, or hospital or clinic that provides such drugs, shall be permitted to refuse to provide a drug that has not been approved by the FDA, if in the judgment of two physicians, such drug is required for an attempt to save a patient's life and no alternative treatment is readily avaliable.

e. The Drug Board established by Section II-10 of LGC 10.17, in addition to the authority provided there, shall identify prescription, generic, and other drugs, that are offered for sale in Lincoln and, at the Board's discretion, conduct an affordability review of any prescription drug product. The board may write and issue reports on such reviews, and may also issue recommendations to not use certain drugs or condemnations of particular drug companies. The board shall not have the power to formally sanction or fine drug companies or employees, except as otherwise provided by law.

3. No State shall impose restrictions on the hiring of employees in bars, restaurants, or liquor stores on the basis of prior criminal conviction, provided nothing in this provision shall act as a waiver on restrictions imposed by a sex offender registry, animal abuse registry, or terrorism registry, and nothing in this provision shall require an employer to hire such individuals, except where otherwise required by law.

4. This act shall take effect immediately.

Congratulating the University of Connecticut Men's Basketball team
for winning the 2023 NCAA National Championship.



WHEREAS, on Monday, April 3, 2023, the University of Connecticut Huskies (the "Huskies") defeated the San Diego State University Aztecs by a score of 76 to 59;

WHEREAS, by virtue of their victory, the Huskies have captured the 2022-23 Division I Men’s Basketball Championship of the National Collegiate Athletic Association (heretofore referred to as the “NCAA”);

WHEREAS, this is the fifth such championship won by the Huskies;

WHEREAS, this victory is a team accolade involving the talents and efforts of many individuals, including Adama Sanogo, Alex Karaban, Andre Jackson, Jordan Hawkins, Tristen Newton, head coach Dan Hurley, and the rest of the players and coaching staff of the Huskies; and

WHEREAS, the tenacity and good sportsmanship shown by the Huskies is a credit not only to the University of Connecticut and the State of Connecticut, but to all citizens of the Region of Lincoln: Now, therefore, be it


RESOLVED, that the General Court of Lincoln -

 (1) congratulates the University of Connecticut Men’s Basketball team, as well as their loyal fans, on becoming NCAA National Champions; and

 (2) respectfully directs the Clerk of the General Court to transmit an enrolled copy of this resolution to -

   (a) the University of Connecticut Men's Basketball Team;

   (b) the Director of Athletics of the University of Connecticut, Mr. David Benedict;

Maximum Wage Law of 2023

Fairness for workers:
1. This bill will be known as the Maximum Wage Law of 2023.
2. Under this law, the following provisions will take place:
A. The Head (CEO, president, superintendent etc) will not be able to make >10x that of the hourly wage of the lowest paid  employee.
B.  The non-head worker with the  highest authority (principal, head manager etc) will not be able to make >5x more  than the hourly wage of the lowest paid employee
C. A boss/manager/immediate employer would not be able to make more than 2x more than the wage of their lowest paying employee. Exceptions may be made if their boss fits in category B.
D. Companies will be required to pay men and women equally and report annual earnings to the governors office. Any failure to pay the same wage will result in a 100% corporate tax for the rest of the fiscal year.

Curbing Greed:
The total annual cap of earnings for an employee will be placed at a total of $460,000 a year adjusted annually for inflation. Any income that exceeds that will be subjected to a 100% income tax on all further income for the rest of the fiscal year.

Implementation:
This bill will take place effective immediately

Section II: Ban on Parking Minimums
a. A public agency shall not impose or enforce any minimum automobile parking requirement on a residential, commercial, or other development project.

b. Notwithstanding subdivision (a), a city, county, municipality, or other local government body may impose or enforce minimum automobile parking requirements on a singular project if the public agency makes written findings, within 30 days of the receipt of a completed application, that not imposing or enforcing minimum automobile parking requirements on the development would have a substantially negative impact, supported by a preponderance of the evidence in the record, due to a combination of at least two of the following:

1. Lack of parking within 1 (one) mile of the development.
2. Lack of public transportation within 1 (one) mile of the development.
3. Lack of sidewalks or similar improved walkable areas along roadways leading to parking within 1 (one) mile of the development. Gravel and dirt paths are not considered improved walkable areas for the purposes of this legislation.

Section III: Timing
a. This legislation will go into effect 10 (ten) days after passage.
