I'd guess "declare martial law" was part of the Trump Treason plan the whole time, after it was clear the lawsuits failed. Consider all the ways the attack on the Capitol, which we now know was organized in advance and that the organizers were connected to Trump cut-outs like Roger Stone, could have ended better for Trump:

And/or, "Hey, wait, we've got a bunch of other Certificates here. This dispute needs to be resolved by Congress, or go to the Supreme Court! Meanwhile, Trump is still President, right?"

Pence is evacuated by the Secret Service to an "undisclosed location" for his "safety">

Is Team Treason? Are those copies secure? Will Trump's lackeys care?)

"Oh, no! We can't risk damage to our historic Capitol, and these people do raise some legitimate questions. Time to declare martial law until we can figure out what is going on. The election certainly can't be certified under these circumstances. Trump will just stay President in the meantime."


What went wrong for the traitors: Trump's lackeys in Congress failed to delay the evacuation. Pence did not act like a traitor, nor a fool. Quick-thinking staffers secured the Certificates. The Virginia National Guard deployed to the Capitol without DoD authorization, which was, like the Washington National Guard themselves, withheld by Trump's DoD lackeys.

Would further treasonous schemes like forcing the election to the House, further challenging the certification and Certificates, or declaring martial law have actually worked?  I don't know, but judging by the GOP's swift return to licking Trump's shoes, it seems possible.

The Republican congressman also told HuffPost yesterday, “I was very frustrated then, I’m frustrated now. I was frustrated then by what was going on in the Capitol. President Biden was in his basement the whole year. Dominion was raising all kinda questions.”

Under federal statute, a person guilty of treason against the United States “shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States.” 18 U.S.C. § 2381.
