Sounds like the Circuit court will probably grant an emergency stay for this.

One good thing in the ruling is that she's allowing the FBI to help in the damage assessment, including if doing so means using the documents in the context of a criminal investigation. Basically they can do what they have to do as far as the damage assessment goes without having to worry about an eventual conviction being overturned because they accidentally violated the order.

Months before National Archives officials retrieved hundreds of classified documents in 15 boxes from former president Donald Trump’s Mar-a-Lago Club, they were told that none of the material was sensitive or classified and that Trump had only 12 boxes of “news clippings,” according to people familiar with the conversations between Trump’s team and the Archives.

During a September 2021 phone call with top Archives lawyer Gary Stern, former deputy White House counsel Pat Philbin offered reassuring news: Philbin said he had talked to former White House chief of staff Mark Meadows, who made the assertion about the dozen boxes of clippings, the people familiar with the call said. Trump’s team was aware of no other materials, Philbin said, relaying information he said he got from Meadows.

The characterization made in the call vastly misrepresented the scale and variety of documents, including classified records, eventually recovered by the Archives or the FBI.

Philbin said that Meadows also told him no documents had been destroyed, according to two people with knowledge of the call and a third person with knowledge of Stern’s contemporaneous account of the call. These and other people spoke on the condition of anonymity to disclose internal details.

Hey that is but 30 minutes away by Path and subway. Maybe I should show up as an "Atlas reporter"). But alas in a couple of days it's  time to return to Hudson before the holdings are claimed by virtue of adverse possession. Otherwise, I might call the court to ask if therapy dogs are allowed in the courtroom. Otherwise, the balance of the pack would have to forage to  their own for pizza slices left on the sidewalk. Lots of pizza in this set of zip codes.

Doubtful it gets granted. The Courts aren't going to see any reason why an independent third party cannot review and/or publicize what was in the documents.

Perhaps the Biden DOJ is concerned it isn't as damning as they make it out to be.

Well, no.  There's a pretty strong reason not to publicize what's in the CLASSIFIED documents.

Yeah the stay is only for the 100 classified documents. The government is acquiescing (for now) to the special master review of the other 10s of thousands of documents.

In another strange twist, it seems that Trump's main lawyer on this case, Christopher Kise, was a registered agent for the Maduro regime back in 2020.  This would likely make it impossible for him to get the level of security clearance needed to view the most highly classified documents if the courts eventually allow Trump's team to have access to them.

This demand for an answer on declassificiation and the October 7th deadline are not helping the strategy of delaying until his servants might win the election and... I guess just impeach Garland over and over? Block a budget to defund the DOJ?

It's beginning to appear that offering Dearie as a candidate for Special Master was a stupid dumb idiot moron decision, but we'll all just have to see.

Yeh, it was always going to come to this sooner or later. I'm just kinda surprised the reckoning on the declassification lie is coming so soon. After trump reflexively lied that he had a standing declassification order while in office immediately after the stolen documents were seized from MAL, it was almost instantly exposed as complete BS when every single one of his Chiefs of Staff and John Bolton no less publicly stated they had never, ever heard of such an order. So far, only Kash Patel has stupidly decided to go along with the lie and go so far as to say he was there when trump announced the order.

Following some of the legal Twitter people at the special master hearing in Brooklyn.  It sounds like Judge Dearie, who has a reputation as a top-notch judge, isn't having any of Trump's nonsense arguments.

Adam Klasfeld (@KlasfeldReports) and Josh Gerstein (@joshgerstein) are a couple of good follows for this.
