Sounds like the Circuit court will probably grant an emergency stay for this.

One good thing in the ruling is that she's allowing the FBI to help in the damage assessment, including if doing so means using the documents in the context of a criminal investigation. Basically they can do what they have to do as far as the damage assessment goes without having to worry about an eventual conviction being overturned because they accidentally violated the order.

Trump team claimed boxes at Mar-a-Lago were only news clippings

Months before National Archives officials retrieved hundreds of classified documents in 15 boxes from former president Donald Trump’s Mar-a-Lago Club, they were told that none of the material was sensitive or classified and that Trump had only 12 boxes of “news clippings,” according to people familiar with the conversations between Trump’s team and the Archives.

During a September 2021 phone call with top Archives lawyer Gary Stern, former deputy White House counsel Pat Philbin offered reassuring news: Philbin said he had talked to former White House chief of staff Mark Meadows, who made the assertion about the dozen boxes of clippings, the people familiar with the call said. Trump’s team was aware of no other materials, Philbin said, relaying information he said he got from Meadows.

The characterization made in the call vastly misrepresented the scale and variety of documents, including classified records, eventually recovered by the Archives or the FBI.

Philbin said that Meadows also told him no documents had been destroyed, according to two people with knowledge of the call and a third person with knowledge of Stern’s contemporaneous account of the call. These and other people spoke on the condition of anonymity to disclose internal details.

The Justice Department on Friday asked an appeals court to put on hold parts of a judge’s order requiring a third-party review of the materials seized last month at Mar-a-Lago.

In its request with the 11th US Circuit Court of Appeals, the Justice Department says it wants the court to allow its criminal investigators to review the materials marked as classified and for the court to exclude those documents from the special master’s review of the search.

The department sought the intervention after District Judge Aileen Cannon on Thursday rejected prosecutors’ request that they be allowed to restart their criminal investigation into the classified documents, which they said was necessary for assessing the national security risks in how the materials had been handled.

“The court’s order hamstrings that investigation and places the FBI and Department of Justice (DOJ) under a Damoclean threat of contempt should the court later disagree with how investigators disaggregated their previously integrated criminal-investigative and national-security activities,” the Justice Department wrote.

In another strange twist, it seems that Trump's main lawyer on this case, Christopher Kise, was a registered agent for the Maduro regime back in 2020.  This would likely make it impossible for him to get the level of security clearance needed to view the most highly classified documents if the courts eventually allow Trump's team to have access to them.

Yeh, it was always going to come to this sooner or later. I'm just kinda surprised the reckoning on the declassification lie is coming so soon. After trump reflexively lied that he had a standing declassification order while in office immediately after the stolen documents were seized from MAL, it was almost instantly exposed as complete BS when every single one of his Chiefs of Staff and John Bolton no less publicly stated they had never, ever heard of such an order. So far, only Kash Patel has stupidly decided to go along with the lie and go so far as to say he was there when trump announced the order.
