Yes. We should be the ones passing regs. Nothing should be a federal crime unless the Senate has voted on it. No more paper crimes based on reg violations when the Peoples senate hasnt even voted on the criminal regs.
You call these things ‘paper crimes’, when in reality these actions can result in a great deal of harm - environmental or otherwise. To assert that violations of agency rulemaking amount to nothing more than victimless crime is ludicrous.

If its a crime that you think is so bad, then the legislative branch should be the one declaring it. It is evil that crimes are being passed into law without the legislative branch being the one to pass them. It is outrageous that crimes could be made that way.
I don't mind Congress stepping in to clarify specific situations where statutory intent is either unclear or strictly implicit, but I am very much against throwing out the entire Chevron deference on the grounds that agency rulemaking derived from reasonable statutory interpretation is in some way wrong or immoral.

Quote
You are claiming "omg these regs are super duper cereal, of course they should be crimes." Well then WE should decide what is cereal as a matter of law.
Jesus H Christ, why are we talking like it's 2011Look, we can still clarify these questions *with* Chevron intact; there's no need to throw the baby out with the bathwater here, given that the People's Senate can already change agency's enabling statute and/or overrule agency rulemaking via the legislative process.

We tried last session to require massively expensive agency rulemakings to have a cost-benefit analysis and undergo a vote by the Senate prior to enactment, like you are suggesting here. The Labor-Old Labor coalition killed it. Now you want to kill this proposal by telling us to bring back OSR's bill that yall killed last session.

Which one are you going to vote for? Affirmative Senate approval before new regs go into effect or the elimination of the court presumption that a reg is of course legal simply because an unelected bureaucrat says so?

Again, you are saying "Dont do A, do B" but last session yall rejected "B" as unworkable. This bill is a good proposal to empower democracy over the deep state swamp.

Bringing this to a final vote. Senators have 24 hours to object.

Lol no, I am talking about doing this on a case-by-case basis where the Congress simply clarifies implicit statute.

Nay, I want to see more debate on this because I'm still unsure as to where to stand on this.
