How many states will have abortion banned outright before the end of the year? I guess several, though if they're smart, I'd wait until after the midterms.

This is brilliant. Hopefully red states push ahead with strict abortion restrictions. I think red states should improve healthcare access too so as to make sure deaths after birth decrease too. Those of us who are pro-life need to be consistent.

Elections have consequences, and that's what happened in 2016 in partiular.

Its 5-1-3. Roberts voted with the majority on the actual issue of the MS abortion ban but did not want to overturn Roe.

Kavanaugh, the 5th vote to overturn Roe, opines in a concurrence in victim that the right to travel protects women traveling to other states to obtain an abortion. So at the end of the day, the practical impact of this should be limited, particularly if the number of states banning abortion entirely, as opposed to just after the first trimester, are rare.



Yeah, just screw the women in rural Texas who might have to travel over a day, or the woman in the Mississippi Delta who can barely afford to get to work.

Guess I shouldn't have expected a sympathetic take from someone who only left the GOP because the Dems in his area advocated an income tax cut or something.

Let this be a lesson that every rwer and blue avatar who cries about “judicial activism” is arguing in bad faith

Lol at the idea that reversing a decision that said the voters do not have a say in what abortion law is through their elected officials is judicial activism .
So if the SCOTUS overturn all the civil rights laws and said that issue like segregation are state issues again you think that would be the ultimate form of democracy?

I think it’s also important to note that the Supreme Court is made up of mostly justices appointed by presidents who lost the popular vote.

This is not a Court representing America. This is a sham Court.

The electoral college must go.

I agree that the process for selecting Supreme Court justices is pretty terrible, and the essence of your post is correct.

But it is worth pointing out that GW Bush didn't appoint any justices until after he had won the popular vote in 2004.  A lot of people believe O'Connor delayed her own retirement for exactly this reason.

This has to be the worst week for supreme court rulings in recent memory.

I would say the week of Dred Scott will never lose that title.

What is the point of winning elections and doing nothing when your opponents win elections and do whatever they feel like it. About 50 years of women's progress has been erased with one dubious court decision. The progressives will have to waste energy continuing to fight this issue when we have other key issues to fight. That puts a HUGE strain of RBG's legacy. This wouldn't have happened if she just retired in 2013 when Obama was POTUS and Dems had a comfortable 55 seat majority. Now it has gotten us such a cr*p ruling.

When his New Deal legislation kept getting struck down, FDR proposed a law targeting justices over the age of 70.

Never forget that when the only Democrat in the House to vote against codifying Roe faced a competitive primary, leadership did a full court press to campaign for him. That "Democrat" won by about 300 votes.

This is why I have no trust in leadership. They own this. Pelosi and Clyburn are likely the reason Henry Cuellar won. They've learned nothing from the lessons of 2020, and continue to press for the nominal mirage of power rather than actual power.

How does the majority opinion compare to the leaked draft?
There are a handful of "Kavanaugh passages" that appear to have been added for the obvious reasons, otherwise it is very similar.

Yeah and he was one of the most powerful and effective leaders to ever hold the office. He had a Trump level personality cult, except he was far more popular with the people at large and far more politically skilled. Really no comparison to Joe Biden, frankly.

Henry Cuellar, a single House Representative, is not why this happened. They were against purity testing on a single issue to harm our overall election chances in that district, because it's better to have a politician who agrees with you on 90% of things than 0% in any House seat, when the vast majority of your members will stop him from posing any harm to your goals on what you do disagree with. It's about not letting the perfect be the enemy of the good.
