I mean, sure, we could argue that, at the time that Ratzinger was a diocesan archbishop, CSA being the uniquely malign and intolerable act that we now know it to be was not yet very well understood, either in the Church or in the secular culture. But Ratzinger/Benedict is one of the figures most associated with the idea that truth and morality do not vary based on a society's willingness to accept them. That defense isn't going to fly when it's him.

They didn't really need to pay a law firm €1k/hr to figure this out, but okay.
