AN ACT
To mandate immunization against COVID-19 as a condition of entry, employment, and student enrollment


Be it enacted by the Senate of the Republic of Atlasia asssembled

Section 1. Title

This legislation may be cited as the Immunization Act of 2021.

Section 2. Mandatory immunization against COVID-19 as a condition of employment and student enrollment

1. All businesses with one hundred or more employees shall be required to enforce compulsory immunization, or a weekly COVID-19 test if preferred, to individuals as a condition of employment.

2. All federal, regional, state, and local agencies shall be required to enforce compulsory immunization, or a weekly COVID-19 test if preferred, to individuals as a condition of employment.

3. All public and private schools, including institutions of higher learning, shall be required to enforce compulsory immunization, or a weekly COVID-19 test if preferred, to individuals as a condition of employment or enrollment for individuals age 16 and above.

4. All companies with one hundred employees or more as well as learning institutions which do not enforce COVID-19 immunization or weekly testing for all individuals, without recommendation from a licensed physician, shall be fined no less than $10,000 per employee or individual.

Section 3. COVID-19 immunization as a condition for entry into the Republic of Atlasia

Immunization against COVID-19 shall be mandatory for all who seek entry into the Republic of Atlasia, including Atlasians currently living abroad as well as immigrants and refugees of other nations.

Section 4. Exemptions

Any individual may be exempt from a vaccination requirement if recommended to by their doctor, but must agree to undergo weekly COVID-19 testing.

Section 5. Effectiveness

This statute shall be effective October 1, 2021.

So this is of course based on Biden's announced rules for COVID-19 immunization and testing for businesses with more than 100 employees, and includes similar requirements for admission to schools for individuals age 16 and up.

It goes without saying that I am inclined to oppose government intervention in the private lives of individuals and their own medical decisions, especially to such an extent. However, if the current pandemic has taught us anything it is that, while bodily autonomy is a right, and one worthy of our protection, so also must it be balanced with the public health and the protection of common rights, including the right to not be infected by serious illness from others.

I have consistently defended bodily autonomy, and I still do. But the question before us is very simple: do we want to continue living under endless mask mandates in a stalled economy, or do we want a return to pre-COVID normalcy?

Vaccination requirements are not unconstitutional, as Jacobson v. Massachusetts has been upheld multiple times by the Supreme Court. And they are not unprecedented. But they are necessary to reach herd immunity, and this bill accomplishes that by applying the same standard to all individuals, both Atlasians and aliens regardless of country of origin or documentation status, in both the public and private sectors.

I urge the Senate to pass this legislation.

I oppose Section 2 of the bill because I do not believe that it is the business of the federal government to compel employers to mandate any medical procedure for their employees.

I concur with Senator AGA regarding Section 2. Nor do I think that the Federal government should be mandating things for the lower levels of government to police this. I will not be supporting this bill. The fact that the Senator from NJ supports this bill, is all the evidence one needs to know that this is not something one should be supporting.

An Alabama man died of a cardiac-related health matter after dozens of hospitals across three states had no available ICU beds due to COVID patient overload.

The consequences of not getting immunized against this virus are clear, and it affects more than the people who get sick because they made the choice not to get the vaccine. I am opening a final vote in 24 hours, barring objections.

Nay. I haven't seen any indication from our COVID-19 case or vaccination numbers that a step as drastic as this is necessary, and the link to an article about a COVID situation inapplicable to Atlasia is indicative of that.

I oppose the push by Anti-vaxxers to mandate restrictions on business ability to require vaccinations and I have repeatedly criticized DeSantis' move to prohibit lower levels of government from requiring masks and/or vaccines.

However, the same applies in reverse. Local governments should make decisions based on the best science available with the help of the higher level governments when requested. Central authority for the pro-vax side can easily be abused and used for the anti-vax side.
