This case was reported when the previous administration picked up the case for prosecution

This morning, HHS officials will announce a new notice of violation, alleging that a major university medical center in Vermont forced a nurse to violate her conscience by assisting with an abortion.

The nurse, who is Catholic and works at the University of Vermont Medical Center, or UVMMC, had made it clear to her employer: She did not want to participate in abortion procedures for reasons of conscience. According to a complaint filed in May 2018 and a subsequent investigation, her wishes were not honored. After being told that she would be treating a patient who had experienced a miscarriage, she discovered that she had actually been scheduled to help with an elective abortion. According to a recently created policy, UVMMC can punish staffers who refuse to participate in abortions when the hospital is short-staffed, and the nurse’s boss allegedly would not allow her to step out of the procedure. Fearing retaliation, or that she would lose her job, the nurse agreed to go through with it. When she walked into the procedure room, the doctor allegedly said to her, “Don’t hate me.”

DOJ under Biden has dropped the case, without explanation.

“Don’t hate me.” According to a lawsuit filed by the Department of Justice last year, that is what an abortionist at the University of Vermont Medical Center (UVMMC) said to a nurse before she forced her to assist in the termination of a child’s life on pain of losing her job and potentially her license if she refused. The nurse in the case had informed her bosses well beforehand that she could not participate in abortion because of her religious and moral convictions. Her right to such a demurrer is protected by federal law, known as the Church Amendments, which Congress passed unanimously in direct response to Roe v. Wade. The facts were stunning in their clarity, the victim was extremely credible and sympathetic, and the violator remained entirely callous and unrepentant. The UVMMC matter was the most open and shut conscience case in over a decade. I say was, because on Friday, the DOJ quietly, and voluntarily, dismissed the case. No admission of guilt, no injunction, no corrective action, no settlement, no nothing. Worse yet, because the victim has few to no options to sue on her own (due to nuances around private rights of action), the Biden administration is effectively giving UVMMC a full pardon and will continue to give it federal funds, despite it having been found by HHS to have violated the law.


By not prosecuting this, they are making a dead letter of Sen. Frank Church's amendments meant to protect freedom of conscience for healthcare workers, and declaring open season on pro-life nurses and doctors.

I could see dropping the case if it had been a medically necessary abortion instead of an elective abortion. But under our system of government, the way to get rid of the Church Amendments is to get Congress to change the law, not for the executive branch to stop enforcing the law.

Yes and no.  As you well know there are scarce resources in all areas of criminal justice: policing, prosecution, the courts...

Those who are in charge always have to pick and choose what areas to concentrate on.  This is very much the same as the Los Angeles County Sheriff who refused to go after people for not wearing masks even though the Los Angeles County government brought bask the mask mandate.

However, if religious exemptions are going to be concentrated on as an area of enforcement, I hope that thousands of medical professionals join a religion that argues that people who don't get vaccinated should be left to themselves, and refuse to treat unvaccinated people.
