Section I. Title
i. This bill may be known as the “Banning Discriminatory Hiring Act.”

Section II. Enforcement
i. This act applies to any corporate entity that conducts business in the Southern Region or is incorporated in the Southern Region

i. Corporate entities found to violate this act by the Southern Attorney General shall be fined the larger of $1,000,000 or 1% of yearly revenues.
ii. Residents of the Southern Region shall retain a private right of action against corporate entities that violate this statute

I plan to vote for this bill.

I wonder how we'll go about with the detection part itself, though. It feels like this is a case where there's always plausible deniability.

I am skeptical of including "past incarceration status" as a protected group. Many jobs need employees who can be trusted to not steal or be violent towards others. Hiring employees is often expensive, and it would make hiring more difficult. I do agree on the rest of the protections in this bill.

I initially included past incarceration status because in an ideal world, I think the serving of a jail sentence should be sufficient restitution to allow a person to re-enter society without any restriction or handicap. However, given that businesses are still liable for employee conduct, I can see why this would be a very relevant consideration in hiring and will not object to this amendment.

While it's obviously too late to edit this bill accordingly, if the Chamber wants a more reasonable limit on using past criminal record, the framework in Jimmy's federal housing discrimination bill might be a good place to start.
