Kennedy was indeed the deciding vote, but it's not like any Democrats defected. (I think one side is probably being more honest about their COVID diagnoses.) I think it might be that other Republicans were voting against Mathis because of the objections of the TN Senators. He said before that it would be unfair if blue slips for circuit judgeships were revived. He also opposed a number of Trump nominees as well.

I'm quite happy to see this nomination go through (as well as the other earlier this week). It's about time. Let's see how many more circuit judgeships can get through this month.

Since my previous post, there was another circuit court nomination, for the 9th Circuit Montana seat. That leaves only four circuit court vacancies without nominees.

Yikes, I hate to say this, but Hassan's doomed reelection bid isn't as important as filling an appellate court seat, and Duckworth probably doesn't need to campaign much anyways. Either she wins by twenty, or the GOP wave is so high she loses no matter what she does.

They both should have been in D.C for this vote.
