Menendez is up for election, but not re-election.

Yeah, I realized that after the fact. Good point.

Still, my main point stands, which is that not only are more GOP seats vulnerable than Democratic ones, but even the most vulnerable Democratic seats (NJ and MN) don't present an opportunity for a gain of votes for this amendment.

I haven't through this entire thread, so I apologize if this has already been covered, but does anyone know the reasoning behind McConnell's and Bennett's 'no' votes? I cannot think of a single other issue that they have voted liberal or libertarian on.

I don't know about Bennett, but McConnell is quite firmly committed to freedom of speech (see this column by him).
