No. Rudy never bothered to file the appeal. The Republican state AGs' grandstanding is all that's left.

Yeah, there's obviously no set timeline or anything, but they're definitely gonna decide pretty quickly. The deadline for PA to respond in Kelly's case, for example, was at 9am yesterday & the Court had already denied by mid-afternoon, right after Kelly replied to PA's response (I think the time in between was ~34 mins.). With the respondents in the TX case - PA, GA, MI, & WI - being given a deadline of tomorrow at 3pm to respond, we should get a decision sometime Friday if the same timeframe holds, which makes sense, given that the Court has a conference meeting on Friday morning at which I presume this will be a topic of discussion.

Of course, it's also possible that the Court could deny even prior to Friday, given how rapidly they denied injunctive relief in Kelly's case. In any event, though, they're definitely gonna get it done before the Electoral College votes on Monday.

Alito wrote an unofficial opinion that is a statement respecting the decision that says he doesn't believe that SCOTUS has the authority to deny the filing of a bill of complaint in a case that falls within the original jurisdiction of SCOTUS, but noted that they wouldn't grant Ken Paxton's request. Thomas joins Alito's opinion. I knew Thomas and Alito were going to do something odd.

It's only "an odd opinion" if you don't know what you're talking about, which you've made clear on issues concerning the Supreme Court time & time again with many of your previous posts on this forum. It's well-known that Alito believes the Constitution establishes the Court's original jurisdiction in mandatory terms, as does Thomas, which is - y'know - why he joined Alito's opinion.

Sigh.

In any event, fantastic that this charade is finally over. What a dumb Hail Mary it was.
