So if someone I know decides, for reasons that elude me, to get involved in some sketchy business deal with foreign investors and randomly says "Oh by the way, we're going to set aside 10% of the equity for my good friend Indy Texas," without ever asking me or mentioning it to me, that's somehow my fault?

No, Biden obviously couldn't be prosecuted for this e-mail alone. But "he didn't put anything in writing, therefore no story" is nearly as ridiculous a suggestion.
