It's a shame RBG won't be there to do it.

Why not Chief Justice John Roberts? Isn't that the Chief Justice's job?

She already swore Gore in back in '97.

As for my guess, Breyer? (If Warren were the running-mate, it'd 100% be him given the Harvard/Boston connections.) This'll probably be his last opportunity to do so, so they might as well reward him.

No the Vice President gets to pick who they want. Cheney had Hastert do it in 2005. Biden had JPS do it in 2009 and Sotomayor do it in 2013. Pence had Thomas swear him in in 2017.

Coin flip between Kagan, Sotomayer, and Pelosi. I went with Kagan since Sotomayer already had the chance to swear in Biden for his second term as VP.

I'll be surprised if its not a woman given the obvious significance of Harris being the first female VP.

Hmm, that’s an interesting point. They might let him do it as one of his final acts as a justive because I hope he retires the next day.

I didn't realize Sotomayor already swore in Biden in 2013. In that case I'd want to see Pelosi. The first female Speaker of the House swearing in the first female Vice President would be cool to see.

It also makes sense because they both represent California and have known each other for a long time.

Is Pelosi even an option?

When was the last time a non-SCOTUS judge swore in a VP?

Probably Sotomayor. Looking back:

2017: Pence: Justice Clarence Thomas
2013: Biden: Justice Sonia Sotomayor
2009: Biden: Justice John Paul Stevens
2005: Cheney: Speaker Dennis Hastert
2001: Cheney: Chief Justice William Rehnquist (same as POTUS)
1997: Gore: Justice Ruth Bader Ginsburg
1993: Gore: Justice Byron White
1989: Quayle: Justice Sandra Day O'Connor
1985: Bush: Justice Potter Stewart
1981: Bush: Justice Potter Stewart
1977: Mondale: Speaker Tip O'Neill
1973: Agnew: Chief Justice Warren Burger (same as POTUS)
1969: Agnew: Senate Minority Leader Everett Dirksen
1965: Humphrey: Speaker John McCormack
1961: Johnson: Speaker Sam Rayburn

Looking back at this list, Speaker Pelosi would be a great choice.

Dark-horse pick (jff): Clyburn.

Would've been John Lewis, but he's dead.

Actually, I'm curious to know how a pandemic inauguration would go at all.

I'm also kind of thinking Kagan to answer the question.

Harris should force Alito, the partisan hack, to swear her in. The GOP loves to troll the libs, so it’s time for the libs to do some counter-trolling

You know the person they ask to swear them in isn't obligated (legally or otherwise) to accept... right?

I vote for Nancy Pelosi but personally I think the Chief Justice should do both.
