No the Vice President gets to pick who they want. Cheney had Hastert do it in 2005. Biden had JPS do it in 2009 and Sotomayor do it in 2013. Pence had Thomas swear him in in 2017.

Coin flip between Kagan, Sotomayer, and Pelosi. I went with Kagan since Sotomayer already had the chance to swear in Biden for his second term as VP.

I'll be surprised if its not a woman given the obvious significance of Harris being the first female VP.

Hmm, that’s an interesting point. They might let him do it as one of his final acts as a justive because I hope he retires the next day.
