When you've been backed into a corner, there's really no place else to go. If Democrats are unwilling to expand the Supreme Court, they should just pack up and go home. We have literally nothing to lose by adding new Justices. As much as we have a written Constitution to live by, we also live by norms and traditions. With those norms and traditions having been completely broken down by one side, there is no reason why the other side should still try to live by said norms and traditions. I will refrain from answering this question until/unless a Biden Presidency and a unified Democratic Congress has the opportunity to respond.

We have literally nothing to lose by adding new Justices. As much as we have a written Constitution to live by, we also live by norms and traditions. With those norms and traditions having been completely broken down by one side, there is no reason why the other side should still try to live by said norms and traditions. I will refrain from answering this question until/unless a Biden Presidency and a unified Democratic Congress has the opportunity to respond.

Dems should definitely try to expand to 12 judges.

The current situation is exactly the thing that will give the Trump crowd the needed boost to win this election for them. Evangelicals who were previously sceptical of supporting Trump again will now come out in hordes to vote for him.

No, I think if we have the power, we should add some new states and go for 15 Justices and have President Biden fill them all in short order. They have broken the norms and declared war on the left. Their war has been stifled by the fact that we control the People's House, the House of Representatives. To be honest, if Democrats don't see the dire need for action quickly, I'm hoping Roe v. Wade is quickly overruled. Sometimes a hard lesson is required to learn and respond.


I'm not surprised you would say that. You have no problem showing off the party label of a party that apparently only stands for incurring misery upon the American people.

Hopefully republicans keep the senate in 2020 to stop the democrats from passing their absolute insane plans and yes court packing is beyond insane and it would show the democrats are just as much of a threat to our institutions as Trump is .

I'm sorry for my late response, but I didn't see this until now. I'm not pretending to have any moral high ground, but neither should you. You should acknowledge that our norms and traditions in government are just as important as what is written into the text. What the Republicans did to President Obama in his first term violated all of the norms and traditions. You can't look back at a few random judges that were blocked by Democrats during the early years of the Bush Administration. You also can't look back at the Bork nomination. In that case, the Democratic Senate granted him a full hearing and a vote on the floor of the Senate. Merrick Garland would've been confirmed on the floor of the Senate in 2016 if he was granted a fair hearing and vote. But going back to Bork, Democrats easily confirmed Anthony Kennedy.

If there's one place I will claim a moral high ground, it's that I am absolutely willing to reach out to Republicans to figure out a new way forward with the judiciary in this country. Neither side should live in terror because a one justice shift in the Court. I've maintained that view for a long time. I would absolutely prefer both sides come together and figure out a new solution going forward. But you and I both know that won't happen because the religious right that dominates the Republican Party will not be happy until SCOTUS declares human life starts at fertilization.
