So if Biden wins in November along with a DEM senate, there would still be a conservative supreme court that he would have to deal with. I have heard that Biden hasnt pushed for a carbon tax because he might fear a backlash, however if there is enough support from congressional democrats and climate groups, he could change his mind and sign it. So I have been wondering would this pass the supreme court? A carbon tax could be a great way to deal with the climate change as we have done so in Canada

Also for other type of taxes,I think a wealth tax would easily be unconstitutional even if there was a liberal supreme court. I also think the ACA will most likely survive a 6-3 supreme court.

It would be constitutional in truth under any court. Whether it's ruled as such by partisan judges is another question

I think a carbon tax would be ruled constitutional, if challenged. But I do wonder if a cap-and-trade scheme would be struck down.

I mean you can have partisan judges who might do so just like the ACA lawsuit(it shouldnt be in the supreme court in the first place)
