Let’s say Roe is overruled (probably would be in 2022). What would an “overruling” even look like? Could the new Supreme Court try to punt as much as possible? Will their voters be expecting more?

And if states finally started operating outside of Roe, what would eventually happen? Would it escalate to a “war on abortion” where only 5 safe D states, if that, just pass personhood laws and we suddenly get a wave of universal natalism and an increase in arrests and incarceration, or does it become like prostitution or suicide where only very liberal places keep it but no one really cares, perhaps it’s like marijuana where states start to very slowly tolerate it in various degrees, or like right to work where states break down mostly 50/50 on the issue, or is a universal compromise reached where abortion becomes strictly an administrative family matter like divorce?

Blue states, and I'm sure a few red states (Kansas, Alaska, Montana), won't comply with an abortion ban.

If Roe v. Wade is overturned, a number of states with Republican trifectas, especially in the South and Appalachia, will outright ban abortion entirely. The women with full pocketbooks will get an abortion anyway by going to a state like New York or California, where abortion is legal. Poorer women, especially teens and women of color, won't have the financial ressources to do so.

Democratic states will pass legislation to keep abortion legal. New York already has done so in 2019. Republican administrations in Washington and Republicans in congress will probably attempt to strip federal funds from blue states if they make abortion legal.

People who believe that abortion is literally murder aren't going to stop just with returning it to the states. They will then move on to trying to get it federally banned, either by courts or the legislative process, and with banning it in every state legislature they can.

We can't say for sure, but we know Thomas would vote to overturn Roe v. Wade, and Roberts, Alito, Gorsuch, Kavanaugh, and Barrett (?) were all appointed with overturning Roe v. Wade in mind. It would take 2 of the above not voting to do so to avoid it.

I really don't see the Supreme Court finding the sort of constitutional right to be born that would be required to outright ban abortion. More likely they'd make some loophole to allow states to pass prohibitive TRAP laws on a grand scale and we might get de facto abortion bans in a couple states.

That’s my guess. No law enforcement funds for abortion bans when Democrats are in power.

That's still a really bad situation for people who can't easily move away from red states. I have a job, family, and a whole life in Mississippi and have no interest in leaving. Could I pack up and leave and get a new job in a blue state? Probably, but I shouldn't have to.

A bunch of poorer women in Republican states get f**ked for life. Abortion is a bad fix to a problem, but republicans seem to just want to ignore that problem completely because life doesn’t continue after birth, or something like that.
That’s why as a pro-lifer, I don’t support ending Roe v Wade until we have universal access to contraceptives, stronger social support for mothers, and Planned Parenthood centers (sans the abortion, obviously)
That’s the “worst case” scenario if you are pro-choice.

There is a good chance it gets fought tooth and nail by everything the Democrats have to the point any attempt just backfires/flounders miserably.

Well, it's going to still be legal in California and New York and some other safe D states.

That means Republicans will have nearby places they can fly their daughters and mistresses to when they need to "get rid of it" and that's good enough for them.

So anyone who has had an abortion before can get arrested when they are visiting? Broke ass states like Missouri love to pull people over. A state trooper trying to tax the motorists going through their states might start arresting people or at least doing hour long background checks on them. Maybe certain states start abortion checkpoints at their border and other states just ban people from other states because there is a risk they are just trying to go in and kidnap people to drag them to court. That’s one thing.

That’s not the worst thing. If a lot of people start moving because of this, won’t there be huge and unnatural demographic shifts? This is why I’m snickering in my last post here.


I’m also pretty sure this will deter some of the more moderate red states like Wyoming, Ohio, Kansas, and Nebraska to treat abortion like a serious vice like prostitution, sodomy, or contraband. There would be a “war on abortion” in these states, but they won’t care about it unless it happens in their states and then, it will be like getting busted for selling weed or hitting someone when you are driving drunk. Some people will get minor felony Jail time but others might get pled down to misdemeanor possession or assault or something.

Then a bunch of swing states will treat abortion like divorce or bankruptcy where there’s a procedure to determine what’s in the best interest of the applicant’s community, applicant’s family, and applicant. They probably will require residency to participate in the procedure and being noncompliant would be the same crime as it would be in the more moderate right to life states.

Then there would be various levels of D states that vary from abortion being legal but only allowed in a certain window after discourages not to have one and states like New York that could allow free abortions.

The effectiveness of abstinence education is at minimum grossly exaggerated, if it is even effective.

But back to the question at hand, the most I can see is return to the status ante-Roe, not a court-mandated abortion ban.
