Yes. Since the retirement of Justice Hugo Black, all of the Justices have been activists at one time or another. The difference between the conservative Justices like Scalia and Thomas and the liberal Justices like Ginsburg has been intensity compared to frequency. Ginsburg legislates from the bench more frequently, whereas Scalia legislates with more intensity.
Bush v. Gore was the most intense display of activism I have ever seen, and Scalia supported the decision and defended it in public.
