My Confederate statues amendment was voted down on the argument that it should be a separate bill, however, under the current format of this bill, it would suggest the regional government can't take action in the future. Proposing an amendment to hopefully alleviate that, but if anyone can think of better wording, I'm open to it. Also adding in the word "public" just to provide certainty this doesn't apply to statues on private land.

Quote
AN ACT
to protect statues of historical figures in the South

Section 1 (Title & Definitions)
i. The title of this act shall be, the “Protecting Our History"

Section 2 (Protecting Statues)
i. Anyone who takes down or participates the vandalism of a statue of a historical figure will be fined $500 for destroying public property. Citizens may choose to permanently take down a public statue only by a ballot referendum in an election or by the regional legislature.
ii. Police departments in jurisdictions where a historical statue is vandalized will be compensated $250.

Section 3 (Implementation)
i. This legislation shall come into effect immediately upon signature by the Governor.
24 hours for objection.

I would have thought that newer legislation would automatically supersede any old legislation when there is conflict, but I have no problem with this language.

I am proposing one final amendment, which I assume there will be an objection for. I've stated my feelings towards Section 2, clause ii, and I'd like to have an up or down vote on that clause before proceeding to a final vote. It is a quite unusual addition and don't believe it is something the government should be involved in, perhaps it is something a private entity would like to pursue. This will be the law of the land for years to come, and there are other circumstances out there where statues are vandalized where I don't see a correlation with compensating the police for.

Amendment:

I strongly disagree with the idea a ballot referendum provides sufficient justification for taking down a statue.

Objection has been noted, there is now a vote on the following amendment:

AN ACT
to protect statues of historical figures in the South

Section 1 (Title & Definitions)
i. The title of this act shall be, the “Protecting Our History"

Section 2 (Protecting Statues)
i. Anyone who takes down or participates the vandalism of a statue of a historical figure will be fined $500 for destroying public property. Citizens may choose to permanently take down a public statue only by a ballot referendum in an election or by the regional legislature.

Aye
I don't see enough reason to compensate local PDs for this, even if I agree with DTC in regards to the necessity of having a fine in place.

The 72 hour amendment vote period has passed, the amendment is adopted by a vote of 3-2. Debate resumes.

Asking that any additional amendment be brought forth in the next 24 hours, at that time I will be requesting a final vote.

I can't say I'd sign this bill in any of the forms it's been in so far. I don't condone this but I'm also thinking $500 is too high of a punishment especially since these statues aren't usually taken down just by a single person?

Honestly I’d rather just have it be up to the discretion of the judge instead of a one size fits all punishment.

I object without knowing your reasoning behind this. Why would you want to remove that part?

I don't think that even a referendum can give legitimacy to the proposition of citizens taking down a statue, and the thought of that happening disgusts me.

I'm not entirely sure how a ballot referendum or a legislature vote on the regional level would work in this case anyway. If there were to be a referendum or vote because some locals want their town's statue/s to be taken down, I'd assume that it would be done by the local council, not at the regional level.
