I'll tell you why curfew laws need to be curtailed. The big reason, of course, is freedom of movement. Does it say anywhere in the constitution that "people must stay in their house at certain times under penalty of arrest?" No? Well then why the hell are these laws a thing? People shouldn't need a reason to be outside.
Now of course these laws target people under 18. And there are plenty of reasons why parents wouldn't want their kids out at night. But that should be a parenting issue, not a police issue.
It's a pretty clear waste of resources if you want to look at it from that standpoint too. What should police be doing at night - trying to solve actual crimes or rounding up teenagers? And of course actual criminals, whether underage or adult, don't give much of a sh*t about these laws anyway.
Isn't the whole point of these curfews road safety - to keep kids under 18 (the least experienced drivers) from driving at night? especially given that the reason most kids would even be out of the house really late at night is to attend parties where we know alcohol is being liberally consumed?
I don't think any police are assigned to "under 18 curfew" duty instead of investigating other matters, it tends to be police already assigned to patrol for traffic violations administering a curfew charge.
At least that's how the curfew laws in my area have tended to work out, maybe there are more expansive curfew laws that I'm not aware of.
This doesn’t affect driving at night which has to do with a drivers license. It’s preventing them from being outside at all at night.
