Interesting for sure, undermines the whole idea of sin taxes, and by extension, the idea of subsidizing certain industries/companies, because it's necessarily a "penalty" on others for not doing whatever the subsidized industry/company is doing.

Can't be too sure if it's really sound. If judged by today's status quo, it's unsound, but just perhaps everything like that is unsound right now and we're just ignoring the intent of the constitution's taxing powers.

Ah, the "three generations of imbeciles are enough" case.  Extremely unsound.

Unsound; "freedom of speech" must be something more than an empty slogan.

Sound as it follows the Constitution to the letter. However it highlights the 'lost in translation' effect of what counts cruel and unusual punishment.

By the illogic used in the decision, once a penalty is declared "unconstitutional" because of the apparent current consensus in existing law as to whether a penalty is too cruel to pass constitutional muster, it is effectively be impossible for the basis of determining consensus to make such a penalty acceptable again constitutionally, even if society's evolving standards determines that it is not too cruel, since few legislatures will bother to pass "unconstitional" punishments.   The Eighth Amendment should be interpreted as a means of protecting convicted defendants from capricious sentences being handed out by judges, not a means of preventing legislatures from specifying the penalties to be imposed for crimes.
