What if the mother and the baby are both likely to die otherwise?

My response answers the question: Should 1st and 2nd trimester abortions remain legal?

First trimester: Qualified yes. Should be greatly restricted to cases of medical or criminal necessity, though.

Second trimester: No, not at all.

I've pretty much become the strangest case you ever saw. While many people are against abortion but admit it's legal, I'm the opposite. While I (provisionally) acknowledge that abortion is not morally wrong, I believe it to be unconstitutional.

Honestly, it's not an issue I tend to bother with - too much philosophy involved. I think first trimester should stay legal, and I don't really care about second either way.

At the time of the 14th amendment's ratification the consensus among the states and the AMA was that abortion constituted a murder. Therefore, the only reason a woman should be allowed to abort is in self-defense (i.e. their health is in jeopardy). Otherwise, it would constitute the state allowing life to be terminated without due process of law. Sure it's questionable to be operating under definitions of science and the states from 1868, but it's better than operating under the definitions of five kooks from 1992.

The principle of "due process of law" is derived from Magna Carta. It simply means that a state can not deprive you of life, liberty, or property, except through the legislative process.
