Sounds like the administration isn't going to challenge the 9th's ruling, but just sign a new EO instead.

clever move, even while it breaks the cheap talking points trump's fand tried to spread the last few days.

this thing wouldn't have passed the SC and that wasn't cause the US government can't control immigration but because this thing was effed up - period.

To be clear, this just means Trump is not going to appeal the stay order to SCOTUS. There's still a whole case to be had on the actual merits of the executive order that could eventually wind its way up to SCOTUS. All the court drama so far has just been on the preliminary question of whether or not the EO should be put on hold while the case is pending.
