So apparently the FBI didn't investigate her statements under oath because they didn't get a request from Congress, and a snickering Chaffetz said "you'll get one!  you'll get one!"

Is she screwed?  Didn't she say flat out that there were no confidential e-mails on her server?

Being wrong isn't perjury. None of this gross negligence stuff; for perjury the government has to prove that someone willfully lied under oath.

Again, it was a political non-referral and a political hearing today. The FBI did not interview Hillary! under oath and there is no indication that whatever Hillary! told the FBI was the same as her public statements (which were obvious lies).

The FBI did not set up a perjury trap for Hillary! They didn't even record the interview. So I do not really know how any charges or referral of charges can be brought against her.

Whether they should have is open for debate and obviously a part of this political Kabuki theater event between Comey and Chafetz. Congress has an absolute right to question Comey under their oversight authority over the FBI.

She brings most of this crap on herself. No one told her to go set up a private e-mail server. If she asked, she'd likely be told it was a very bad idea and that it would pose a security risk. Then she goes and lies about whether she transmitted classified information.

 I really have no sympathy or tolerance for these kind of unnecessary shenanigans. Convenience (aka flouting the Sunshine laws) should not trump national security.
